IN-CONTEXT TRANSLATIONS

[In addition to the application of all regulatory control mechanisms, DG SANCO will devise an anti-fraud strategy in line with the Commission's anti-fraud strategy (CAFS) adopted on 24 June 2011 in order to ensure inter alia that its internal anti-fraud related controls are fully aligned with the CASF and that its fraud risk management approach is geared to identify fraud risk areas and adequate responses. Where necessary, networking groups and adequate IT tools dedicated to analysing fraud cases related to the financing implementing activities of the Veterinary Medicinal Products Regulation will be set up. In particular a series of measures will be put in place such as: - decisions, agreements and contracts resulting from the financing implementing activities of the Regulation will expressly entitle the Commission, including OLAF, and the Court of Auditors to conduct audits, on-the-spot checks and inspections; - during the evaluation phase of a call for proposals/tender, the proposers and tenderers are checked against the published exclusion criteria based on declarations and the Early Warning System (EWS); - the rules governing the eligibility of costs will be simplified in accordance with the provisions of the Financial Regulation; - regular training on issues related to fraud and irregularities is given to all staff involved in contract management as well as to auditors and controllers who verify the beneficiaries' declarations on the spot.
[DG SANCO zal niet alleen alle controlemechanismen waarin de regelgeving voorziet toepassen, maar ook een antifraudestrategie opzetten overeenkomstig de op 24 juni 2011 goedgekeurde nieuwe antifraudestrategie van de Commissie (CAFS), onder meer om te waarborgen dat zijn interne antifraudegerelateerde controles volledig met de CAFS in overeenstemming zijn en dat zijn benadering van frauderisicobeheer erop gericht is risicogebieden voor fraude op te merken en daar passend op te reageren. Zo nodig zullen netwerkgroepen worden opgericht en passende IT-instrumenten worden ontwikkeld voor de analyse van fraudegevallen in verband met de uitvoeringsactiviteiten van de verordening betreffende geneesmiddelen voor diergeneeskundig gebruik waarmee financiering gemoeid is. Onder meer de volgende maatregelen zullen worden genomen: - in besluiten, overeenkomsten en contracten die voortvloeien uit de uitvoeringsactiviteiten van de verordening waarmee financiering gemoeid is, zal expliciet worden vermeld dat de Commissie, inclusief OLAF, en de Rekenkamer bevoegd zijn audits, controles ter plaatse en inspecties te verrichten; - tijdens de evaluatiefase van een oproep tot het indienen van voorstellen/aanbesteding wordt aan de hand van verklaringen en het vroegtijdige waarschuwingssysteem (EWS) gecontroleerd of de bekendgemaakte uitsluitingscriteria niet op de indieners van de voorstellen en de inschrijvers van toepassing zijn; - de regels in verband met de subsidiabiliteit van de kosten zullen worden vereenvoudigd overeenkomstig de bepalingen van het Financieel Reglement; - alle personeelsleden die betrokken zijn bij contractbeheer, alsook auditors en controleurs die de verklaringen van de begunstigden ter plaatse onderzoeken, krijgen geregeld opleiding over thema’s die verband houden met fraude en onregelmatigheden.

Without prejudice to the first and the second subparagraphs, cooperation agreements with third countries and international organisations, grant agreements, grant decisions and contracts resulting from the implementation of this Regulation shall expressly entitle the Commission, the Court of Auditors and OLAF to conduct such audits, on-the-spot checks and inspections.
Onverminderd de eerste en de tweede alinea verlenen de uit deze verordening voortvloeiende samenwerkingsovereenkomsten met derde landen en internationale organisaties, subsidieovereenkomsten en -besluiten en contracten de Commissie, de Rekenkamer en OLAF uitdrukkelijk de bevoegdheid om dergelijke audits en controles en verificaties ter plaatse uit te voeren.

38. Welcomes the fact that since 2009 the Commission has carried out extensive audits on the spot to review the work of audit authorities; notes that it carried out 269 audit missions and reviewed 47 and 84 Audit Authorities for ERDF and ESF, respectively; notes that the missions covered approximately 96 % and 99 % of the total allocations, respectively; is of the opinion that during a financing period the Commission should audit all operational programmes (OP) at least once;

Without prejudice to paragraphs 1 and 2, cooperation agreements with third countries and international organisations, grant agreements, grant decisions and contracts resulting from the implementation of this Regulation shall contain provisions expressly empowering the Commission, the Court of Auditors and OLAF to conduct the audits, on-the-spot checks and inspections referred to in those paragraphs, in accordance with their respective competences.
3. Onverminderd leden 1 en 2, worden de Commissie, de Rekenkamer en OLAF in samenwerkingsovereenkomsten met derde landen en internationale organisaties, in subsidieovereenkomsten en subsidiebesluiten en in overeenkomsten die voortvloeien uit de uitvoering van deze verordening, uitdrukkelijk gemachtigd tot het verrichten van in die leden bedoelde audits en controles en verificaties ter plaatse, overeenkomstig hun respectieve bevoegdheden.

18. Recalls that under Article 287(3) of the Treaty on the Functioning of the European Union the European Court of Auditors has the right, if necessary, to perform its audit on the spot in the premises of any body, office or agency which manages revenue or expenditure on behalf of the Union;
