It is no surprise, then, to see many references to this in the basic texts that govern relations between the European Union and third countries, starting with the Cotonou Agreement, which includes, in particular, a clause on human rights and democracy in the context of the political dialogue with the ACP countries.

1. Recalls that, under Article 185 of the Financial Regulation, Parliament shall give discharge for the implementation of the budgets of the bodies set up by the Communities and having legal personality which actually receive grants charged to the budget; points out, however, that not all of these bodies are fully, or even partially, funded via grants charged to the budget; emphasises that the discharge decision therefore covers both the budget and the non-budget funding of these bodies; considers it unacceptable that some of the bodies set up by the Union are accountable for the expenditure of income received from sources other than the budget whilst others, which do not receive a subsidy from the budget, are not; affirms the principle that all Community agencies, whether or not they are subsidised, are subject to discharge by Parliament, even when another discharge authority intervenes in accordance with their basic texts; takes the view that there is a need to review all texts that go against this principle;
1. herinnert eraan dat overeenkomstig artikel 185 van het Financieel Reglement het Europees Parlement kwijting verleent voor de uitvoering van de begrotingen van de door de Gemeenschappen opgerichte organen met rechtspersoonlijkheid die daadwerkelijke subsidies ten laste van de begroting ontvangen; wijst er echter op dat niet al deze organen volledig of zelfs gedeeltelijk worden gefinancierd met subsidies ten laste van de begroting; benadrukt dat het kwijtingsbesluit daarom zowel betrekking heeft op de financiering ten laste van de begroting als op de financiering niet ten laste van de begroting; acht het onaanvaardbaar dat een aantal van de door de Unie opgerichte organen verantwoording moeten afleggen van de besteding van uitgaven die zijn ontvangen uit andere bronnen dan de begroting, terwijl andere organen, die geen subsidie ten laste van de begroting ontvangen, dit niet hoeven; bevestigt het beginsel dat alle communautaire agentschappen, ongeacht of zij subsidies ontvangen, kwijting van het Parlement moeten krijgen, ook indien overeenkomstig hun basisbesluit een andere kwijtingsautoriteit optreedt; is van mening dat alle teksten die tegen dit beginsel ingaan, herzien moeten worden;

From a procedural point of view, since two texts on the same subject have been referred to Parliament, the parliamentary committee concerned will have to decided which of the two texts it wishes to adopt as the basic text to be submitted to the House (application, mutatis mutandis, of Rule 41(4) of the Rules of Procedure).
Met betrekking tot de procedure zij opgemerkt dat aan het Parlement twee teksten over hetzelfde onderwerp zijn voorgelegd, en dat de Commissie burgerlijke vrijheden derhalve zal moeten beslissen welke van deze beide teksten zij als basistekst wenst voor te leggen aan de plenaire vergadering (met dienovereenkomstige toepassing van artikel 41, lid 4 van het Reglement).
