In order to respect the general principle on which the outline Directive is based, which is to leave to the trade the choice of the means of attestation of conformity and thus to prohibit Member States from setting up any system of control prior to placing on the market (except, of course, in cases where prior control is required by specific Directives for special sectors, as is moreover clearly provided for in point VIII), it is obvious that the national authorities in order to acquit themselves of their responsibilities set out in this clause must be allowed to exercise control on the market by way of spot checks.

Met inachtneming van het algemene beginsel dat ten grondslag ligt aan het richtlijnschema, namelijk het bedrijfsleven de keuze te laten van de verklaringen van overeenstemming (natuurlijk met uitzondering van gevallen, waarin door bijzondere richtlijnen voor nader omschreven sectoren in een voorafgaande controle zou worden voorzien, als vermeld in punt VIII, sub 2), en waarbij het de Lid-Staten derhalve wordt verboden stelsels van voorafgaande controle voor het in de handel brengen in te voeren, is het duidelijk dat de nationale autoriteiten, ten einde zich van de in deze bepaling vastgestelde verantwoordelijkheid te kunnen kwijten, controles door middel van steekproeven moeten kunnen uitoefenen.
