IN-CONTEXT TRANSLATIONS

This Directive, while applying to all collective management organisations, with the exception of Title III, which applies only to collective management organisations managing authors’ rights in musical works for online use on a multi-territorial basis, does not interfere with arrangements concerning the management of rights in the Member States such as individual management, the extended effect of an agreement between a representative collective management organisation and a user, i.e. extended collective licensing, mandatory collective management, legal presumptions of representation and transfer of rights to collective management organisations.
Deze richtlijn is van toepassing op alle collectieve beheerorganisaties, met uitzondering van titel III die alleen van toepassing is op collectieve beheerorganisaties die op multiterritoriale basis auteursrechten inzake muziekwerken voor onlinegebruik beheren, maar doet geen afbreuk aan regelingen betreffende rechtenbeheer in de lidstaten, zoals individueel beheer, het uitgebreide effect van een overeenkomst tussen een vertegenwoordigende collectieve beheerorganisatie en een gebruiker, d.w.z. uitgebreide collectieve licentieverlening, verplicht collectief beheer, wettelijk vermoeden van vertegenwoordiging en overdracht van rechten aan collectieve beheerorganisaties.

Member States shall ensure that where a collective management organisation does not grant or offer to grant multi-territorial licences for online rights in musical works or does not allow another collective management organisation to represent those rights for such purpose by 10 April 2017, rightholders who have authorised that collective management organisation to represent their online rights in musical works can withdraw from that collective management organisation the online rights in musical works for the purposes of multi-territorial licensing in respect of all territories without having to withdraw the online rights in musical works for the purposes of mono-territorial licensing, so as to grant multi-territorial licences for their online rights in musical works themselves or through any other party they authorise or through any collective management organisation complying with the provisions of this Title.
De lidstaten zien erop toe dat wanneer een collectieve beheerorganisatie uiterlijk op 10 april 2017 geen multiterritoriale licenties voor onlinerechten inzake muziekwerken verleent of aanbiedt te verlenen en geen andere collectieve beheerorganisatie toestaat die rechten voor een dergelijk doel te beheren, rechthebbenden die die collectieve beheerorganisatie hebben gemachtigd om hun onlinerechten inzake muziekwerken te beheren, de onlinerechten inzake muziekwerken ten behoeve van multiterritoriale licentieverlening voor alle grondgebieden uit die collectieve beheerorganisatie kunnen terugtrekken zonder de onlinerechten inzake muziekwerken ten behoeve van monoterritoriale licentieverlening te hoeven terugtrekken, teneinde zelf of via enige andere partij die zij machtigen of via een collectieve beheerorganisatie die wel voldoet aan de voorwaarden van deze titel, multiterritoriale licenties voor hun onlinerechten inzake muziekwerken te verlenen.

3. Where a collective management organisation mandates another collective management organisation to grant multi-territorial licences for the online rights in musical works under Articles 29 and 30, the mandated collective management organisation shall also apply paragraph 2 of this Article with respect to the rightholders whose musical works are included in the repertoire of the mandating collective management organisation, unless the collective management organisations agree otherwise.
3. Wanneer een collectieve beheerorganisatie een andere collectieve beheerorganisatie op grond van de artikelen 29 en 30 machtigt om multiterritoriale licenties voor de onlinerechten inzake muziekwerken te verlenen, past de lastnemende collectieve beheerorganisatie lid 2 van dit artikel ook toe met betrekking tot de rechthebbenden wier muziekwerken opgenomen zijn in het repertoire van de lastgevende collectieve beheerorganisatie, tenzij de collectieve beheerorganisaties anders overeenkomen.

To protect the interests of the rightholders of the mandating collective management organisation and to ensure that small and less well-known repertoires in Member States can access the internal market on equal terms, it is important that the repertoire of the mandating collective management organisation be managed on the same conditions as the repertoire of the mandated collective management organisation and that it is included in offers addressed by the mandated collective management organisation to online service providers.
Om de belangen van de rechthebbenden van de lastgevende collectieve beheerorganisatie te beschermen en te waarborgen dat kleine en minder bekende repertoires in de lidstaten gelijke toegang tot de interne markt hebben, is het belangrijk dat het repertoire van de lastgevende collectieve beheerorganisatie onder dezelfde voorwaarden wordt beheerd als het repertoire van de lastnemende collectieve beheerorganisatie en dat het wordt opgenomen in aanbiedingen die de lastnemende collectieve beheerorganisatie doet aan aanbieders van onlinediensten.

Membership of collective management organisations should be based on objective, transparent and non-discriminatory criteria, including as regards publishers who by virtue of an agreement on the exploitation of rights are entitled to a share of the income from the rights managed by collective management organisations and to collect such income from the collective management organisations.
Het lidmaatschap van collectieve beheerorganisaties moet gebaseerd zijn op objectieve, transparante en niet-discriminerende criteria, onder meer ten aanzien van uitgevers die op grond van een overeenkomst over de exploitatie van rechten recht hebben op een deel van de inkomsten uit de door collectieve beheerorganisaties beheerde rechten en het recht hebben dergelijke inkomsten te innen van de collectieve beheerorganisaties.

3. (10) With regard to collective portfolio management (management of unit trusts/common funds and investment companies), the authorisation granted to a management company authorised in its home Member State should permit the company to carry on in host Member States the following activities: to distribute the units of the harmonised unit trusts/common funds managed by the company in its home Member State; to distribute the shares of the harmonised investment companies, managed by such a company; to perform all the other functions and tasks included in the activity of collective portfolio management; to manage the assets of investment companies incorporated in Member States other than its home Member State; to perform, on the basis of mandates, on behalf of management companies incorporated in Member States other than its home Member State, the functions included in the activity of collective portfolio management.
(10) De aan een beheermaatschappij in haar lidstaat van herkomst verleende vergunning moet de beheermaatschappij in staat stellen in de lidstaten van ontvangst de volgende werkzaamheden in verband met het beheer van collectieve beleggingsportefeuilles (beheer van unit trusts/beleggingsfondsen en beleggingsmaatschappijen) uit te oefenen: verhandelen van de rechten van deelneming in de geharmoniseerde unit trusts/beleggingsfondsen die door de beheermaatschappij in haar lidstaat van herkomst worden beheerd; verhandelen van de aandelen in de geharmoniseerde beleggingsmaatschappijen die door de beheermaatschappij worden beheerd; vervullen van alle overige taken die onder het beheer van collectieve beleggingsportefeuilles vallen; beheren van de activa van beleggingsmaatschappijen met statutaire zetel in een andere lidstaat dan de lidstaat van herkomst van de beheermaatschappij; vervullen, in opdracht en voor rekening van beheermaatschappijen met statutaire zetel in een andere lidstaat dan de lidstaat van herkomst van de betrokken beheermaatschappij, van de taken die tot het beheer van collectieve beleggingsportefeuilles behoren.

(10) With regard to collective portfolio management (management of unit trusts/common funds and investment companies), the authorisation granted to a management company authorised in its home Member State should permit the company to carry on in host Member States the following activities: to distribute the units of the harmonised unit trusts/common funds managed by the company in its home Member State; to distribute the shares of the harmonised investment companies, managed by such a company; to perform all the other functions and tasks included in the activity of collective portfolio management; to perform, on the basis of mandates, on behalf of management companies incorporated in Member States other than its home Member State, the functions included in the activity of collective portfolio management.
(10) De aan een beheermaatschappij in haar lidstaat van herkomst verleende vergunning moet de beheermaatschappij in staat stellen in de lidstaten van ontvangst de volgende werkzaamheden in verband met het beheer van collectieve beleggingsportefeuilles (beheer van unit trusts/beleggingsfondsen en beleggingsmaatschappijen) uit te oefenen: verhandelen van de rechten van deelneming in de geharmoniseerde unit trusts/beleggingsfondsen die door de beheermaatschappij in haar lidstaat van herkomst worden beheerd; verhandelen van de aandelen in de geharmoniseerde beleggingsmaatschappijen die door de beheermaatschappij worden beheerd; vervullen van alle overige taken die onder het beheer van collectieve beleggingsportefeuilles vallen; vervullen, in opdracht en voor rekening van beheermaatschappijen met statutaire zetel in een andere lidstaat dan de lidstaat van herkomst van de betrokken beheermaatschappij, van de taken die tot het beheer van collectieve beleggingsportefeuilles behoren.
