"commercial document" means all books, registers, vouchers and supporting documents, accounts, production and quality records, and correspondence relating to the undertaking's business activity, as well as commercial data, in whatever form they may take, including electronically stored data, in so far as these documents or data relate directly or indirectly to the transactions referred to in paragraph 1.

‘commercial communication’ means any form of communication designed to promote, directly or indirectly, the goods, services or image of an undertaking, organisation or person engaged in commercial, industrial or craft activity or practising a regulated profession.

1. For the purpose of this Agreement, "companies or firms of a Member State or an ACP State" mean companies or firms constituted under civil or commercial law, including corporations, whether public or otherwise, cooperative societies and other legal persons and partnerships governed by public or private law, save for those which are non-profit-making, formed in accordance with the law of a Member State or an ACP State and whose statutory office, central administration or principal place of business is a Member State or an ACP State.

(f) companies under French law known as "société anonyme", "société en commandite par actions", "société à responsabilité limitée", "sociétés par actions simplifiées", "sociétés d'assurances mutuelles", "caisses d'épargne et de prévoyance", "sociétés civiles" which are automatically subject to corporation tax, "coopératives", "unions de coopératives", industrial and commercial public establishments and undertakings, and other companies constituted under French law subject to French corporate tax;
f) De vennootschappen naar Frans recht, geheten "société anonyme", "société en commandite par actions", "société à responsabilité limitée", "sociétés par actions simplifiées", "sociétés d'assurances mutuelles", "caisses d'épargne et de prévoyance", "sociétés civiles" die automatisch aan de vennootschapsbelasting onderworpen zijn, "coopératives", "unions de coopératives" alsmede de overheidsinstellingen en -bedrijven met een industrieel of commercieel karakter, alsmede andere vennootschappen die zijn opgericht naar Frans recht en die onder de Franse vennootschapsbelasting vallen.

Whereas the restrictions on freedom to provide services in respect of intermediaries in the employment of one or more industrial or commercial undertakings should be abolished under this Directive ; whereas it is sometimes difficult to distinguish between activities of employed intermediaries and those of self-employed agents because the legal distinction between the two is not the same in all six countries ; whereas the activities of employed intermediaries fall within the same economic category as those of self-employed agents and it would be neither convenient nor useful to split up the liberalisation of this very special form of provision of services into a series of measures of partial liberalisation, effected as and when the activities of the employers are liberalised;
Overwegende dat het dienstig is door de onderhavige richtlijn de beperkingen van het vrij verrichten van diensten voor de tussenpersonen in loondienst van een of meer ondernemingen op het gebied van industrie of handel op te heffen ; dat de werkzaamheid van tussenpersonen in loondienst soms moeilijk te onderscheiden is van die van zelfstandige vertegenwoordigers omdat de juridische afbakening tussen beide groepen in de zes Lid-Staten niet dezelfde is ; dat het hier een werkzaamheid betreft met dezelfde economische strekking als die van de zelfstandige vertegenwoordigers en dat splitsing van de liberalisatie van deze zeer bijzondere vorm van dienstverlening in gedeeltelijke liberalisaties , naarmate de werkzaamheden van de werkgevers geliberaliseerd worden , zeer lastig zou zijn en geen zin zou hebben ;
