In the context of the analysis of implementation of Community law in 2006 I would call especially on those Member States who could benefit most from structural funding within the framework of the 2007-2013 Financial Framework to adjust their national law to European law swiftly and appropriately. I have in mind in particular the area of environmental protection, so that effective use is made of available structural resources and the social and economic development of the regions accelerated.

However, the attempts by some national constitutional courts to review individual provisions of Community law in order to decide whether they are covered by a ratification law amounts to a scarcely-veiled challenge to the supremacy of Community law since it mixes the bodies of Community law and national law in an unacceptable fashion.

De bewering van enkele constitutionele rechtbanken dat zij de bevoegdheid hebben om voor individuele bepalingen van de Gemeenschap na te gaan of zij gedekt zijn door een zogenaamd "Zustimmungsgesetz" is daarentegen niets anders dan een slecht verhulde betwisting van het primaat van het Gemeenschapsrecht, omdat hierbij het geheel aan rechtsregels van het Gemeenschapsrecht en v an het nationale recht op ontoelaatbare wijze worden vermengd.

Until a few years ago, the relationship between Community law, on the one hand, and national constitutional law, on the other, seemed largely to have been clarified: although the Community Treaties contain no explicit provisions governing the question of hierarchy, the European Court of Justice had consistently upheld, since its 1964 and 1970 judgments in the cases of Costa v. ENEL and Internationale Handelsgesellschaft, the absolute supremacy of both primary and secondary Community law over all provisions of national law - including constitutional law and the fundamental rights guaranteed thereby.
De verhouding tussen het Gemeenschapsrecht enerzijds en het nationaal constitutioneel recht anderzijds leek tot enkele jaren geleden vrij duidelijk vastgelegd: weliswaar bevatten de Verdragen tot oprichting van de Gemeenschap geen uitdrukkelijke regeling van de rangorde, doch het Europees Hof van Justitie bekrachtigde sinds de in 1964 en 1970 uitgebrachte arresten in de zaak Costa/ ENEL en Internationale Handelsgesellschaft in zijn jurisdictie steeds weer de absolute voorrang van het primaire en het afgeleide Gemeenschapsrecht vóór alle normen van het nationale recht - met inbegrip van het constitutioneel recht en de hierdoor gewaarborgde grondrechten.

'Although the Treaty has made it possible in a number of instances for private persons to bring a direct action, where appropriate, before the Court of Justice, it was not intended to create new remedies in the national courts to ensure the observance of Community law other than those already laid down by national law. On the other hand . it must be possible for every type of action provided for by national law to be available for the purpose of ensuring observance of Community provisions having direct effect, on the same conditions concerning the admissibility and procedure as would apply were it a question of ensuring observance of national law.` (6).

Whereas Community law in its present form provides - notwithstanding one of the fundamental rules of the Community, namely the free movement of goods - that obstacles to movement within the Community, resulting from disparities in national legislation relating to the marketing of products, must be accepted in so far as such requirements can be recognized as being necessary to satisfy imperative requirements; whereas, therefore, the harmonization of laws in this case must be limited only to those requirements necessary to satisfy the essential requirements relating to terminal equipment; whereas these requirements must replace the relevant national requirements because they are essential;
