(1) Decision No 1982/2006/EC of the European Parliament and of the Council of 18 December 2006 concerning the Seventh Framework Programme of the European Community for research, technological development and demonstration activities (2007-2013) (║ "the Seventh Framework Programme") provides for Community participation in research and development programmes undertaken by several Member States, including participation in the structures created for the execution of those programmes, within the meaning of Article 169 of the Treaty.

Council Decision 2006/974/EC of 19 December 2006 on the Specific Programme ‘Capacities’ implementing the Seventh Framework Programme of the European Community for research, technological development and demonstration activities (2007 to 2013) (hereinafter referred to as the Specific Programme ‘Capacities’) identifies an Article 169 initiative in the field of Research Performing Small and Medium-Sized Enterprises (SMEs) as one of the fields suitable for Community participation in national research programmes jointly implemented on the basis of Article 169 of the Treaty.
Volgens Beschikking 2006/974/EG van de Raad van 19 december 2006 betreffende het specifiek programma „Capaciteiten” tot uitvoering van het zevende kaderprogramma van de Europese Gemeenschap voor activiteiten op het gebied van onderzoek, technologische ontwikkeling en demonstratie (2007-2013) (hierna „het specifiek programma „Capaciteiten”” genoemd) is een Artikel 169-initiatief op het gebied van onderzoek verrichtende kleine en middelgrote ondernemingen (kmo’s) een van de gebieden die geschikt zijn voor deelneming van de Gemeenschap aan nationale onderzoeksprogramma’s die gezamenlijk worden uitgevoerd op basis van artikel 169 van het Verdrag.

(8) Article 168 of the EC Treaty stipulates that in implementing the multiannual framework programme, supplementary programmes may be decided on involving the participation of only those Member States which shall finance them, subject to possible Community participation, and therefore Community initiatives must be restricted to covering activities for which none of the Member States oppose the fact that they are funded from the Community budget.
(8) In artikel 168 van het EG-Verdrag wordt bepaald dat bij de tenuitvoerlegging van het meerjarenkaderprogramma kan worden besloten tot aanvullende programma's waaraan alleen wordt deelgenomen door bepaalde lidstaten, die zorgdragen voor de financiering daarvan, onder voorbehoud van een eventuele deelneming van de Gemeenschap. Bijgevolg moet het optreden van de Gemeenschap beperkt blijven tot activiteiten waarover alle lidstaten ermee akkoord gaan (of er zich alvast niet tegen verzetten) dat ze uit de communautaire begroting worden gefinancierd.

2. Special consideration shall be given to the possibility of co-financing in cases where Community participation will encourage the participation of other sources of finance and where such financing may lead to an advantageous financial package for the ACP State concerned.

In this context, project staff must develop a sound understanding of community motivations and aspirations, identify social or cultural constraints to community participation, and monitor whether particular groups within communities have participated and benefited fully from the programme.
