Welcomes the Commission Communication on the application of Directive 2000/43/EC of 29 June 2000 implementing the principle of equal treatment between persons irrespective of racial or ethnic origin (COM(2006)0643)), which seeks to establish a framework to combat discrimination based on racial or ethnic origin in order to ensure that the principle of equality before the law, equal opportunities and equal treatment is consolidated in the Member States, whilst fully complying with the principle of subsidiarity and respecting the various national traditions and procedures; while appreciating the overview of the implementation of the Directive contained in the Commission Communication, notes that it would also have been useful to have been provided with a detailed description of the way in which the provisions of Directive 2000/43/EC have been incorporated into national law, as specified in the Directive itself; further notes that the Commission undertook not only to collect detailed information, but also to report on it to Parliament and the Council and that Parliament, in its resolution of 14 June 2006 on non-discrimination and equal opportunities for all – a framework strategy , asked the Commission to 'examine as a matter of urgency the quality and content of the laws implementing the anti-discrimination directives';

Whenever it appears to the Commission, either on the basis of the reports referred to in paragraph 2 or on the basis of other information, that a third country does not grant undertakings having their seat or their principal fields of activity in the Community, treatment comparable to that granted by the Community to undertakings from that country, the Commission may submit proposals to the Council for an appropriate mandate for negotiation with a view to obtaining comparable treatment for undertakings having their seat or their principal fields of activity in the Community.

Indien de Commissie op grond van de in lid 2 bedoelde verslagen of op basis van andere informatie vaststelt dat een derde land de ondernemingen die hun zetel of hun belangrijkste werkterreinen in de Gemeenschap hebben, geen behandeling geeft die vergelijkbaar is met die welke de Gemeenschap toekent aan ondernemingen van dat derde land, kan zij aan de Raad voorstellen doen om een passend onderhandelingsmandaat te verkrijgen, teneinde voor ondernemingen die hun zetel of hun belangrijkste werkterreinen in de Gemeenschap hebben, een vergelijkbare behandeling te verkrijgen.

(8) On the basis of Article 13 of the Treaty establishing the European Community, the Council has adopted the following directives: Directive 2000/43 of 29 June 2000 implementing the principle of equal treatment between persons irrespective of racial or ethnic origin which prohibits discrimination based on racial or ethnic origin in, inter alia, employment, vocational training, education, goods and services and social protection; Directive 2000/78 of 27 November 2000 establishing a general framework for equal treatment in employment and occupation which prohibits discrimination in employment and occupation on the grounds of religion or belief, disability, age and sexual orientation, and Directive 2004/113/EC of 13 December 2004 implementing the principle of equal treatment between men and women in the access to and supply of goods and services.
(8) Op grond van artikel 113 van het Verdrag tot oprichting van de Europese Gemeenschap heeft de Raad de volgende richtlijnen aangenomen: Richtlijn 2000/43 van 29 juni 2000 vastgesteld houdende toepassing van het beginsel van gelijke behandeling van personen ongeacht ras of etnische afstamming, die discriminatie op grond van ras of etnische afstamming onder andere verbiedt bij de toegang tot arbeid, beroepsopleiding, onderwijs, goederen en diensten en sociale bescherming, alsook Richtlijn 2000/78/EG van 27 november 2000 tot instelling van een algemeen kader voor gelijke behandeling in arbeid en beroep, die met betrekking tot arbeid en beroep discriminatie op grond van godsdienst of overtuiging, handicap, leeftijd of seksuele geaardheid verbiedt, alsmede Richtlijn 2004/113/EG van 13 december 2004 houdende toepassing van het beginsel van gelijke behandeling van mannen en vrouwen bij de toegang tot en het aanbod van goederen en diensten.

Member States shall ensure that producers, or third parties acting on their behalf, set up schemes, using the best available treatment and recycling techniques with regard to the protection of human health and the environment, to provide for the treatment of spent batteries and accumulators collected in accordance with Article 9 that are consistent as a minimum with Community legislation, in particular as regards health, safety and waste management.

For this reason, the proposal includes certain provisions that constitute a series of mechanisms to ensure effective remedies in the event of discrimination.
