Containers used at work for chemical substances or mixtures classified as hazardous according to the criteria for any of the hazard classes or categories 2.1 to 2.16, 3.1 to 3.6, 3.7 adverse effects on sexual function and fertility or on development, 3.8 effects other than narcotic effects, 3.9 and 3.10 in accordance with Regulation (EC) No 1272/2008 of the European Parliament and of the Council on classification, labelling and packaging of substances and mixtures, and containers used for the storage of such hazardous substances or mixtures, together with the visible pipes containing or transporting hazardous substances and mixtures, must be labelled with appropriate pictograms in accordance with that Regulation.

While Directive 2002/95/EC on the restriction of the use of certain hazardous substances in electrical and electronic equipment (RoHS) contributes effectively to reducing hazardous substances in new EEE, hazardous substances such as mercury, cadmium, lead, hexavalent chromium and polychlorinated biphenyls (PCBs) and ozone depleting substances [14] will still be present in WEEE for many years.
Hoewel Richtlijn 2002/95/EG betreffende beperking van het gebruik van bepaalde gevaarlijke stoffen in elektrische en elektronische apparatuur (BGS) doeltreffend bijdraagt tot het verminderen van de hoeveelheid gevaarlijke stoffen in nieuwe elektrische en elektronische apparatuur (EEA), zullen gevaarlijke stoffen zoals kwik, cadmium, lood, zeswaardig chroom, polychloorbifenylen (PCB’s) en ozonafbrekende stoffen[14] nog vele jaren lang in AEEA worden aangetroffen.

Exemptions from the substitution requirement should be permitted if substitution is not possible from the scientific and technical point of view or if the negative environmental or health impacts caused by substitution are likely to outweigh the human, animal and environmental benefits of the substitution, or where scientific evidence demonstrates that their use does not result in any significant risk to health or the environment .The health and safety of users of electrical and electronic equipment should also not be jeopardised by the substitution of the hazardous substances in such equipment.

(9b) The scope of the Directive should , in the future, be expanded to include other hazardous substances used in electrical and electronic equipment.
(9 ter) Het toepassingsgebied van de richtlijn moet in de toekomst worden uitgebreid tot andere gevaarlijke stoffen die in elektrische en elektronische apparatuur worden gebruikt.

Restricting the use of these hazardous substances will enhance the possibilities and economic profitability of recycling of WEEE and decrease the negative health impact on workers in recycling plants.
Door het gebruik van deze gevaarlijke stoffen te beperken zullen de mogelijkheden en de economische voordelen van het recyclen van AEEA toenemen en de negatieve gevolgen voor de gezondheid van de werknemers in recyclinginstallaties verminderen.
