Taking part in the Platform's activities is without prejudice to the Member States' competences and/or obligations to tackle undeclared work, including their national or international responsibilities under, inter alia, relevant and applicable International Labour Organization (ILO) conventions, such as Convention No 81 concerning Labour Inspection in Industry and Commerce.

The Member States have already ratified a large number of ILO conventions relating, in particular, to core labour standards, labour inspection, labour administration, employment, social security and wages[7]. A large number have ratified more recent conventions (health and safety at work, working conditions).
De lidstaten hebben reeds een groot aantal IAO-verdragen geratificeerd, met name op het gebied van sociale grondrechten, arbeidsinspectie, arbeidsbeheer, beroep en beroepsuitoefening, sociale zekerheid en lonen[7]. Calls on the Member States, in accordance with Article 17 of ILO Convention No 189, to establish effective and accessible complaint mechanisms and means of ensuring compliance with national laws and regulations for the protection of domestic workers; calls, furthermore, on the Member States to develop and implement measures for labour inspection, enforcement and penalties with due regard for the special characteristics of domestic work, in accordance with national laws and regulations; asks that, in so far as this is compatible with national laws and regulations, such measures specify the conditions under which access to household premises may be granted, having due respect for privacy; asks the Member States, in line with national regulations, to consider mechanisms to effectively address abuses, such as in-house inspections in cases where there are grounds for suspicion of abuse.
verzoekt de lidstaten om overeenkomstig artikel 17 van IAO-Verdrag nr. 189 te voorzien in doeltreffende en toegankelijke klachtenmechanismen en hulpmiddelen om de naleving van de nationale wet- en regelgeving inzake de bescherming van huishoudelijk personeel te verzekeren; verzoekt de lidstaten voorts maatregelen voor arbeidsinspecties, handhaving en sancties te ontwikkelen en ten uitvoer te leggen, met inachtneming van de specifieke kenmerken van huishoudelijk werk, overeenkomstig de nationale wet- en regelgeving; vraagt dat in dergelijke maatregelen, voor zover verenigbaar met de nationale wet- en regelgeving, specifiek wordt omschreven onder welke voorwaarden toegang tot een woonhuis mag worden verleend, met inachtneming van de privacy; verzoekt de lidstaten om overeenkomstig de nationale regelgeving na te denken over mechanismen om misbruik effectief aan te pakken, bijvoorbeeld met inspecties ter plaatse indien een vermoeden van misbruik bestaat.

(8c) The Platform should fully respect and act in accordance with the Charter of Fundamental Rights of the European Union, in particular Articles 5, 15, 28 and 31 thereof, and the relevant conventions and recommendations of the ILO, in particular Convention No 81concerning Labour Inspection in Industry and Commerce, Convention No 189 concerning decent work for domestic workers, Convention No 150 concerning Labour Administration: Role, Functions and Organisation and Recommendation No 198 concerning the employment relationship.

EU countries must ensure their administrations implement the relevant international conventions* concerning the inspection and certification of ships flying their flag.

Member States should, if they have not already done so, ratify and implement all relevant international Conventions, including the UN Convention against Transnational Organized Crime, its supplementary Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children and the Protocol Against the Smuggling of Migrants by Land, Sea and Air, the UN Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography, the UN Convention on the Protection of the Rights of all Migrant Workers and their Families, the Council of Europe Convention on Action against Trafficking in Human Beings, International Labour Organisation Conventions and core labour standards, in particular No 29 concerning forced labour, No 182 concerning the prohibition and immediate action for the elimination of the worst forms of child labour, and those relating to freedom of association, labour inspection and employment agencies,

The specialised technical competence of the labour inspection is frequently called into question, especially in Member States with general inspections, while in Member States with specialised inspections, the most frequent criticism concerns the lack of inspectors.
