A. whereas DEHP is included in Annex XIV to Regulation (EC) No 1907/2006 (the REACH Regulation) because of its classification as a category 1B substance that is toxic to reproduction; whereas DEHP is on the REACH candidate list because of its reprotoxic properties;

B. whereas the Commission is aiming, through a draft implementing decision on the identification of bis(2-ethylhexyl) phthalate (DEHP), dibutyl phthalate (DBP), benzyl butyl phthalate (BBP) and diisobutyl phthalate (DIBP) as substances of very high concern according to Article 57(f) of Regulation (EC) No 1907/2006 of the European Parliament and of the Council, to identify DEHP as a substance of very high concern;

E. whereas, on 12 December 2014, the Member State Committee (MSC) unanimously agreed to the identification of DEHP as a substance giving rise to an equivalent level of concern due to its endocrine disrupting properties in the environment ; whereas the MSC unanimously acknowledged that, in the case of DEHP, there is scientific evidence on endocrine disrupting activity and on the causal link between this activity and adverse effects on human health;
E. overwegende dat het Comité lidstaten (Member State Committee, MSC) op 12 december 2014 unaniem heeft besloten tot de identificering van DEHP als stof die even zorgwekkend is als gevolg van de hormoonontregelende eigenschappen in het milieu ; overwegende dat het MSC unaniem heeft vastgesteld dat er voor DEHP wetenschappelijk bewijs is van hormoonontregeling en van het oorzakelijke verband tussen deze ontregeling en negatieve gevolgen voor de menselijke gezondheid;

Other examples of products - banned in the EU in 2012 – include a skin lightening product which contained hydroquinone (its use is prohibited in cosmetics and personal hygiene products) and a plastic doll containing 38.5% by weight of di(2-ethylhexyl) phthalate (DEHP) posing a chemical risk.

On the basis of the text agreed by the Council, toys and childcare articles will be forbidden and cannot be placed on the market if DEHP, DBP or BBP occur in concentrations exceeding 0,1% of the plasticised part of the item.
