This should take into account the recommendations made by the Working Party on the Protection of Individuals with regard to the Processing of Personal Data set up under Article 29 of Directive 95/46/EC (‘Article 29 Data Protection Working Party’) and contained in its ‘Working document on data protection and privacy implications in eCall initiative’, adopted on 26 September 2006.
Dat dient rekening te houden met de aanbevelingen van de bij artikel 29 van Richtlijn 95/46/EG opgerichte Groep voor de bescherming van personen in verband met de verwerking van persoonsgegevens („Groep gegevensbescherming artikel 29”) die vervat zijn in zijn op 26 september 2006 goedgekeurde werkdocument betreffende de gevolgen van het eCall-initiatief voor de gegevensbescherming en de privacy.

(13) According to the recommendations made by the Article 29 Data Protection Working Party and contained in the 'Working document on data protection and privacy implications in eCall initiative', adopted on 26 September 2006[9], any processing of personal data through the eCall in-vehicle system should comply with the personal data protection rules provided for in Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data[10] and in Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications)[11], in particular to guarantee that vehicles equipped with eCall in-vehicle systems, in their normal operational status related to 112 eCall, are not traceable and are not subject to any constant tracking and that the minimum set of data sent by the in-vehicle eCall system includes the minimum information required for the appropriate handling of emergency calls.

It is of particular importance that the Commission carry out appropriate consultations during its preparatory work, including at expert level and with relevant stakeholders, consulting in particular consumer protection organisations, as well as the European Data Protection Supervisor and the Article 29 Data Protection Working Party in accordance with the applicable legislation.
Het is van bijzonder belang dat de Commissie bij haar voorbereidende werkzaamheden tot passende raadpleging overgaat, onder meer op deskundigenniveau en met de relevante belanghebbenden, en met name consumentenbeschermingsorganisaties raadpleegt, alsook de Europese Toezichthouder voor gegevensbescherming en de Groep gegevensbescherming artikel 29, overeenkomstig de toepasselijke wetgeving.

(7 quater) Overeenkomstig de aanbevelingen van de groep "gegevensbescherming artikel 29", die vervat zijn in het op 26 september 2006 goedgekeurde werkdocument betreffende de gevolgen van het eCall-initiatief vanuit het oogpunt van bescherming van gegevens en van de persoonlijke levenssfeer, moeten de lidstaten er bij de invoering van de infrastructuur voor eCall-alarmcentrales voor zorgen dat de verwerking van persoonsgegevens bij de afhandeling van eCalls volledig voldoet aan de regels inzake de bescherming van persoonsgegevens die zijn vastgesteld in Richtlijn 95/46/EG van het Europees Parlement en de Raad van 24 oktober 1995 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens en Richtlijn 2002/58/EG van het Europees Parlement en de Raad van 12 juli 2002 betreffende de verwerking van persoonsgegevens en de bescherming van de persoonlijke levenssfeer in de sector elektronische communicatie (richtlijn betreffende privacy en elektronische communicatie).

The eCall service has been designed to follow the recommendations made by the Article 29 Data Protection Working Party and contained in the working document on data protection and privacy implications of the eCall initiative, adopted on 26 September 2006, namely that vehicles equipped with eCall devices should not be traceable in their normal operational status and that the minimum set of data sent by the eCall device should include the minimum information required for the appropriate handling of emergency calls.
