Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Many drug users take more than one type of psychoactive substance. The main diagnosis should be classified, whenever possible, according to the substance or class of substances that has caused or contributed most to the presenting clinical syndrome. Other diagnoses should be coded when other psychoactive substances have been taken in intoxicating amounts (common fourth character .0) or to the extent of causing harm (common fourth character .1), dependence (common fourth character .2) or other disorders (common fourth character .3-.9). Where Member States use the longer implementation period expiring seven years after the date of entry into force of this Directive for meeting the logging obligations for automated processing systems set up prior to that date, the controller or the processor should have in place effective methods for demonstrating the lawfulness of the data processing, for enabling self-monitoring and for ensuring data integrity and data security, such as logs or other forms of records.

2. The Commission shall review within three years after the entry into force of this Directive other acts adopted by the European Union which regulate the processing of personal data by competent authorities for the purposes of prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, in particular those acts adopted by the Union referred to in Article 59, in order to assess the need to align them with this Directive and make, where appropriate, the necessary proposals to amend these acts to ensure a consistent approach on the protection of personal data within the scope of this Directive.
2. De Commissie gaat binnen drie jaar na de inwerkingtreding van deze richtlijn na of de andere besluiten die de Europese Unie in verband met de verwerking van persoonsgegevens door bevoegde autoriteiten met het oog op de voorkoming, het onderzoek, de opsporing en de vervolging van strafbare feiten of de tenuitvoerlegging van straffen heeft vastgesteld, en met name de in artikel 59 bedoelde door de Unie vastgestelde besluiten, aan deze richtlijn moeten worden aangepast en dient in voorkomend geval de nodige voorstellen in om deze besluiten te wijzigen teneinde een conforme aanpak van de bescherming van persoonsgegevens binnen de werkingssfeer van deze richtlijn te waarborgen.

Moreover, on the basis of Article 22(3) Europol may, before the entry into force of the agreement or working arrangement referred to in paragraph 2, directly receive and use information, including personal data, from the entities referred to in paragraph 1 in so far as that is necessary for the legitimate performance of its tasks, and it may, under the conditions laid down in Article 24(1), directly transmit information included personal data, to such entities, in so far as that is necessary for the legitimate performance of the recipient’s tasks.

3. Prior to the entry into force of an agreement or arrangement as referred to in paragraph 2, Eurojust may directly receive and use information, including personal data, from the entities referred to in paragraph 1, in so far as this is necessary for the legitimate performance of its tasks, and it may directly transmit information, including personal data, to such entities, in so far as this is necessary for the legitimate performance of the recipient’s tasks and in accordance with the rules on data protection provided in this Decision.
3. Voorafgaand aan de inwerkingtreding van de overeenkomst of afspraak als bedoeld in lid 2, kan Eurojust rechtstreeks van de in lid 1 bedoelde entiteiten informatie, onder andere persoonsgegevens, ontvangen en gebruiken voor zover zulks voor de gewettigde uitvoering van zijn taken noodzakelijk is; tevens kan Eurojust naar die entiteiten rechtstreeks informatie, onder andere persoonsgegevens, toezenden, voor zover zulks noodzakelijk is voor de gewettigde uitvoering van de taken van de ontvangende entiteit en overeenkomstig de regels in dit besluit inzake gegevensbescherming.

Regarding the Directive of the European Parliament and of the Council on the retention of data processed in connection with the provision of publicly available electronic communications services and amending Directive 2002/58/EC, the Netherlands will be making use of the option of postponing application of the Directive to the retention of communications data relating to Internet access, Internet telephony and Internet e-mail, for a period not exceeding 18 months following the date of entry into force of the Directive.

This means, that whereas it would be legitimate to process the passenger data transmitted for the performance of border checks also for the purposes of allowing their use as evidence in proceedings aiming at the enforcement of the laws and regulations on entry and immigration, including their provisions on the protection of public policy (ordre public) and national security, any further processing in a way incompatible with those purposes would run counter to the principle set out in Article 6(1)(b) of Directive 95/46/EC.
