In addition to the "television without frontiers" Directive, which constitutes the legal framework for the pursuit of television broadcasting activities in the European Union, reference should be made to Directive 93/83/EEC "cable and satellite" [49], which aims to coordinate certain rules concerning copyright and rights related to copyright applicable to satellite broadcasting and cable retransmission with a view to facilitating cross-border broadcasting of audiovisual programmes.
Naast de richtlijn "Televisie zonder grenzen", die het juridisch referentiekader vormt voor omroepactiviteiten in de Europese Unie, dient te worden verwezen naar Richtlijn 93/83/EEG "Kabel en satelliet" [49], waarmee wordt gestreefd naar coördinatie van een aantal voorschriften op het gebied van auteursrechten en naburige rechten die van toepassing zijn op satellietomroep en de doorgifte via de kabel, om grensoverschrijdende uitzending van audiovisuele programma's te vereenvoudigen.

Thus, Directive 93/83/EC "cable and satellite", which is linked to the "television without frontiers" Directive, aims to coordinate certain rules concerning copyright and rights related to copyright applicable to satellite broadcasting and cable retransmission so as to facilitate cross-border broadcasting of audiovisual programmes.

The Directive has been complemented in particular by Council Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce, in the internal market (the e-commerce Directive) [35] and by Council Directive 1993/83/EEC on the coordination of certain rules concerning copyright and rights related to copyright applicable to satellite broadcasting and cable retransmission [36] ("cable and satellite Directive").

The provision of satellite network services for the conveyance of radio and television programmes is a telecommunications service for the purpose of this Directive and thus subject to its provisions. Notwithstanding the abolition of certain special and exclusive rights in respect of receive-only satellite earth stations not connected to the public network of a Member State and the abolition of special and exclusive rights in respect of satellite services provided for public or private broadcasters, the content of satellite broadcasting services to the general public or private broadcasters, the content of satellite broadcasting services to the general public provided via frequency bands defined in the Radio Regulations for both Broadcasting Satellite Services (BSS) and Fixed-Satellite Services (FSS) will continue to be subject to specific rules adopted by Member States in accordance with Community law and is not, therefore, subject to the provisions of this Directive.
17. Overwegende dat het aanbieden van satellietnetwerkdiensten voor het doorgeven van radio- en televisieprogramma's een telecommunicatiedienst is in de zin van deze richtlijn; dat derhalve de bepalingen van deze richtlijn daarop van toepassing zijn; dat niettegenstaande de afschaffing van bepaalde bijzondere en uitsluitende rechten met betrekking tot ontvanggrondstations die niet op het openbare net van een Lid-Staat zijn aangesloten, en de opschaffing van bijzondere en uitsluitende rechten met betrekking tot satellietdiensten ten behoeve van openbare of particuliere omroepinstellingen, op de inhoud van satellietomroepdiensten voor het algemene publiek, die via de frequentiebanden die in het Radioreglement voor satellietomroepdiensten en vastesatellietdiensten bedoeld zijn, worden aangeboden, specifieke voorschriften van toepassing blijven, die door de Lid-Staten in overeenstemming met het Gemeenschapsrecht worden vastgesteld; dat derhalve de bepalingen van deze richtlijn niet daarop van toepassing zijn;

(7) Whereas the free broadcasting of programmes is further impeded by the current legal uncertainty over whether broadcastsing by a satellite whose signals can be received directly affects the rights in the country of transmission only or in all countries of reception together; whereas, since communications satellites and direct satellites are treated alike for copyright purposes, this legal uncertainty now affects almost all programmes broadcast in the Community by satellite;
(7) Overwegende dat de vrije uitzending van programma's voorts wordt belemmerd door de huidige juridische onzekerheid ten aanzien van de vraag of uitzending via een satelliet waarvan de signalen rechtstreeks kunnen worden ontvangen, uitsluitend gevolgen heeft voor de rechten in het uitzendingsland dan wel voor de rechten in alle ontvangstlanden te zamen; dat, ingevolge de gelijkstelling uit auteursrechtelijk oogpunt van omroepsatellieten en telecommunicatiesatellieten, dit gebrek aan rechtszekerheid zich thans voor nagenoeg alle in de Gemeenschap per satelliet uitgezonden programma's doet gevoelen;
