If question 1 is answered in the affirmative: may a provider who makes telephone numbers available, and who is obliged under national legislation to request a subscriber’s consent prior to inclusion in standard telephone directories and standard directory enquiry services, differentiate in the request for consent on the basis of the non-discrimination principle according to the Member State in which the company requesting the information as referred to in Article 25(2) of Directive 2002/22/EC provides the telephone directory and directory enquiry service?
Als vraag 1 bevestigend wordt beantwoord: mag de aanbieder die telefoonnummers in gebruik geeft, en die op grond van een nationale regeling gehouden is de abonnee toestemming te vragen voor opname in standaard telefoongidsen en standaard abonnee-informatiediensten, in de vraag om toestemming op grond van het non-discriminatiebeginsel differentiëren naar de lidstaat waarin de onderneming die verzoekt om informatie als bedoeld in artikel 25, tweede lid, van richtlijn 2002/22/EG, de telefoongids en abonnee-informatiedienst aanbiedt?

Customers should be informed of their rights with respect to the use of their personal information in subscriber directories and in particular of the purpose or purposes of such directories, as well as their right, free of charge, not to be included in a public subscriber directory, as provided for in Directive 2002/58/EC (Directive on privacy and electronic communications).
De klanten moeten op de hoogte worden gebracht van hun rechten met betrekking tot het gebruik van hun persoonlijke informatie in abonneegidsen, met name van het doel of de doelen van deze gidsen, alsmede van hun recht om kosteloos niet in een openbare abonneegids te worden opgenomen, overeenkomstig Richtlijn 2002/58/EG (richtlijn betreffende privacy en elektronische communicatie).

D. whereas the business practices complained of typically consist of an approach made, usually by mail, by a business-directory company to businesses inviting them to complete or update their business name and contact details and giving them the false impression that they will be listed in a business directory free of charge; whereas signatories later discover that they have, in fact, unintentionally signed up to a contract, normally binding them for a minimum of three years, to be listed in a business directory at a yearly charge of some EUR 1 000,

Providers of public directories should inform the subscribers to be included in such directories of the purposes of the directory and of any particular usage which may be made of electronic versions of public directories especially through search functions embedded in the software, such as reverse search functions enabling users of the directory to discover the name and address of the subscriber on the basis of a telephone number only.
Aanbieders van openbare abonneelijsten dienen de in dergelijke abonneelijsten op te nemen abonnees op de hoogte te brengen van de doeleinden van de abonneelijst en van eventueel bijzonder gebruik dat gemaakt kan worden van de elektronische versies van openbare abonneelijsten, in het bijzonder door middel van in de software opgenomen zoekfuncties, zoals omgekeerde zoekfuncties waarmee gebruikers de naam en het adres van een abonnee kunnen vinden op basis van alleen het telefoonnummer.

Member States shall ensure that all exclusive and/or special rights with regard to the establishment and provision of directory services on their territory, including both the publication of directories and directory enquiry services, are abolished.
De lidstaten zorgen ervoor, dat alle uitsluitende en/of bijzondere rechten met betrekking tot de totstandbrenging en het verrichten van gidsdiensten op hun grondgebied, hieronder begrepen de publicatie van telefoongidsen en het verrichten van telefooninlichtingendiensten, worden afgeschaft.
