TRADUCTIONS EN CONTEXTE

Currently the EIA Directive is being further amended by the proposed Directive [19] transposing the second pillar of the Aarhus convention concerning public participation in environmental decision-making into EU legislation (COM (2000) 839 final). The definitions provided in the Aarhus Convention are to be inserted into the EIA Directive.

The UNECE database on Transboundary EIA (www.mos.gov.pl/enimpas) is incomplete: there are entries listing national institutions (Points of Contact for Notification, and Focal Points for the Implementation of the UNECE Convention), but little detail on any projects subject to the Convention.

The amending Directive 97/11/EC added two of these project types to Annex I and one (deforestation) to Annex II; it also moved a further eight Espoo Convention project types from Annex II to Annex I to make the EIA Directive compatible with the Convention.

Highlights the fact that the Environmental Impact Assessment (EIA) as well as strategic and social impact assessment processes will be central tools in the management of concrete projects and programmes in the Arctic; draws attention to Directive 2001/42/EC on Strategic Environmental Assessment (SEA) and to the fact that Finland, Sweden and Norway have ratified the UNECE Convention on EIA in a Transboundary Context (Espoo Convention), which will provide a good basis for the active promotion of impact assessment procedures in the Arctic; refers in this regard also to the Bergen Statement issued by the Ministerial Meeting of the OSPAR Commission of 23 and 24 September 2010;

Due to the nature of the Nordstream project (a pipeline of 1200 km running across the territory of more than one Member State and with consequent environmental impacts in one Member State potentially affecting another one) an Environmental Impact Assessment (EIA) is currently being carried out in the framework of the United Nations Economic Commission for Europe (UNECE) Convention on EIA in a Transboundary Context (the Espoo Convention 1991), which also satisfies the requirements of the EIA Directive 85/337/EC as amended .

The Environmental Impact Assessment (EIA) directive has been amended by Directive 97/11/EC in order to bring the EIA Directive into line with the requirements of the Convention on Environmental Impact Assessment in a Transboundary Context (Espoo Convention).
