17. The provision of satellite network services for the conveyance of radio and television programmes is a telecommunications service for the purpose of this Directive and thus subject to its provisions. Notwithstanding the abolition of certain special and exclusive rights in respect of receive-only satellite earth stations not connected to the public network of a Member State and the abolition of special and exclusive rights in respect of satellite services provided for public or private broadcasters, the content of satellite broadcasting services to the general public or private broadcasters, the content of satellite broadcasting services to the general public provided via frequency bands defined in the Radio Regulations for both Broadcasting Satellite Services (BSS) and Fixed-Satellite Services (FSS) will continue to be subject to specific rules adopted by Member States in accordance with Community law and is not, therefore, subject to the provisions of this Directive.
17. Overwegende dat het aanbieden van satellietnetwerkdiensten voor het doorgeven van radio- en televisieprogramma's een telecommunicatiedienst is in de zin van deze richtlijn; dat derhalve de bepalingen van deze richtlijn daarop van toepassing zijn; dat niettegenstaande de afschaffing van bepaalde bijzondere en uitsluitende rechten met betrekking tot ontvanggrondstations die niet op het openbare net van een Lid-Staat zijn aangesloten, en de opschaffing van bijzondere en uitsluitende rechten met betrekking tot satellietdiensten ten behoeve van openbare of particuliere omroepinstellingen, op de inhoud van satellietomroepdiensten voor het algemene publiek, die via de frequentiebanden die in het Radioreglement voor satellietomroepdiensten en vastesatellietdiensten bedoeld zijn, worden aangeboden, specifieke voorschriften van toepassing blijven, die door de Lid-Staten in overeenstemming met het Gemeenschapsrecht worden vastgesteld; dat derhalve de bepalingen van deze richtlijn niet daarop van toepassing zijn;

15. However, where the provision of satellite services is concerned, licensing or declaration procedures are justified in order to ensure compliance with essential requirements, subject to the proportionality principle. Licensing is not justified when a mere declaration procedure would suffice to attain thte relevant objective. For example, in the case of provision of a satellite service which involves only the use of a dependent VSAT earth station in a Member State, the latter should impose no more than a declaration procedure.
15. Overwegende dat, ten aanzien van het aanbieden van satellietdiensten, procedures voor het verlenen van vergunningen of het afgeven van verklaringen echter gerechtvaardigd zijn om ervoor te zorgen dat de essentiële vereisten in acht worden genomen, mits met inachtneming van het proportionaliteitsbeginsel; dat vergunningsprocedures niet gerechtvaardigd zijn, indien met een procedure voor het afgeven van een verklaring kan worden volstaan om het beoogde doel te bereiken; dat bij voorbeeld in het geval van het aanbieden van satellietdiensten waarbij slechts van een afhankelijk VSAT-grondstation in een Lid-Staat gebruik wordt gemaakt, hiervoor niet meer dan een procedure voor het afgeven van een verklaring moet worden opgelegd;
