The application addresses Iceland’s failure to comply, no later than 24 November 2014, with a reasoned opinion delivered by the EFTA Surveillance Authority on 24 September 2014 regarding that State’s failure to implement into its national legal order Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council, as referred to at points 7a, 7e and 7i of Annex XIX to the Agreement on the European Economic Area, and as adapted to that Agreement by way of Protocol 1 thereto (‘the Act’).
Het verzoek betreft het feit dat de Republiek IJsland op 24 november 2014 nog geen gevolg had gegeven aan een met redenen omkleed advies dat de Toezichthoudende Autoriteit van de EVA op 24 september 2014 tot haar had gericht en dat betrekking had op het door deze staat niet naar behoren uitvoering geven aan Richtlijn 2011/83/EU van het Europees Parlement en de Raad van 25 oktober 2011 betreffende consumentenrechten, tot wijziging van Richtlijn 93/13/EEG van de Raad en van Richtlijn 1999/44/EG van het Europees Parlement en de Raad en tot intrekking van Richtlijn 85/577/EEG en van Richtlijn 97/7/EG van het Europees Parlement en de Raad, waarnaar is verwezen in de punten 7a, 7e en 7i van bijlage XIX bij de Overeenkomst betreffende de Europese Economische Ruimte, en aangepast aan die overeenkomst bij Protocol 1 daarbij (hierna „het besluit” genoemd).

Declare that Iceland has failed to fulfil its obligations under the Act referred to at points 7a, 7e and 7i of Annex XIX to the Agreement on the European Economic Area, (Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council), as adapted to the Agreement by way of Protocol 1 thereto, and under Article 7 of the Agreement, by failing to adopt the measures necessary to implement the Act within the time prescribed.

WHEREAS the conclusions on a homogenous extended single market and EU relations with Non-EU Western European countries adopted by the Council of the European Union in December 2014 acknowledged the key role played by the Agreement on the European Economic Area throughout the last 20 years in advancing economic relations and internal market integration between the EU and the those EFTA States which are part of the EEA;
OVERWEGENDE dat de Raad van de Europese Unie in zijn conclusies van december 2014 over een homogene uitgebreide eengemaakte markt en over EU-betrekkingen met West-Europese landen die geen EU-lidstaat zijn, de hoofdrol heeft onderkend die de Overeenkomst betreffende de Europese Economische Ruimte de afgelopen 20 jaar bij het verbeteren van de economische betrekkingen en de integratie op de interne markt tussen de EU en de EVA-staten die deel uitmaken van de EER heeft gespeeld;

declare that by failing to ensure payment of the minimum amount of compensation to Icesave depositors in the Netherlands and in the United Kingdom provided for in Article 7(1) of the Act referred to at point 19a of Annex IX to the Agreement on the European Economic Area (Directive 94/19/EC of the European Parliament and of the Council of 30 May 1994 on deposit-guarantee schemes) within the time limits laid down in Article 10 of the Act, Iceland has failed to comply with the obligations resulting from that Act, in particular its Articles 3, 4, 7 and 10, and/or Article 4 of the Agreement on the European Economic Area;

On 14 December 2010, the Council recalled, in its conclusions, that Iceland is a democracy that has a long history of good functioning, with strong institutions and close relations to the EU. It also concluded that Iceland’s general preparedness was sufficient for it to adopt and apply the EU acquis, in particular, due to the fact that the country is a member of the European Economic Area and party to the Schengen Agreement.
Op 14 december 2010 heeft de Raad er in zijn conclusies aan herinnerd dat IJsland al geruime tijd een goed functionerende democratie is met sterke instellingen en nauwe betrekkingen met de EU. Hij heeft tevens vastgesteld dat de algemene voorbereiding van IJsland voldoende was voor overname en toepassing van het EU-acquis, vooral dankzij het feit dat het land lid is van de Europese Economische Ruimte en partij is van het Schengenakkoord.

(SV) Let me begin by reminding you of what was stated in the Council’s conclusions of 8 December, where the Council writes the following: ‘Iceland is a country with long and deep democratic roots, with the potential to make a significant contribution to the EU, both strategically and politically. The country is already closely integrated with the EU in several areas, through its membership of the European Economic Area and the Schengen area’.
(SV) Staat u mij toe om u, om te beginnen, te herinneren aan wat er in de conclusies van de Raad van 8 december staat. Daarin schrijft de Raad het volgende: ”IJsland is een land met een lange en diepgewortelde democratische traditie, dat zowel strategisch als politiek een belangrijke bijdrage kan leveren tot de EU. Het land is reeds op meerdere gebieden nauw geïntegreerd met de EU door zijn lidmaatschap van de Europese Economische Ruimte en het Schengengebied”.

In fact, the European Union has established a variety of relationships with other European countries. We have a comprehensive structure of bilateral agreements with Switzerland; we have the European Economic Area, which is a very far-reaching arrangement of economic integration; and we have the European Neighbourhood Policy.
De Europese Unie heeft zelfs een heel scala aan betrekkingen met andere Europese landen ontwikkeld: we hebben een uitgebreid pakket van bilaterale verdragen met Zwitserland; we hebben de Europese Economische ruimte, een zeer vergaand akkoord over economische integratie, en we hebben het Europees nabuurschapsbeleid.

(1) This Regulation establishes a Neighbourhood and Partnership Instrument to provide assistance (hereinafter ‘Community assistance’) for the sustainable development of an area of prosperity and good neighbourliness involving the European Union and the countries listed in Annex 1 (hereinafter ‘partner countries’). Community assistance under this Regulation shall be co-ordinated with other Community programmes and especially with the European Economic Area, taking into account the Northern Dimension as well as co-operation within the Barents Euro-Arctic Council and the Arctic Council.
Communautaire bijstand uit hoofde van deze verordening wordt gecoördineerd met andere communautaire programma's en in het bijzonder met de Europese Economische Ruimte, waarbij rekening wordt gehouden met de Noordelijke dimensie alsmede met de samenwerking binnen de Euro-Arctische Raad van de Barentszzee en de Arctische Raad.

(31) Whereas the Agreement on the European Economic Area provides for greater cooperation in the field of education, training and youth between the European Community and its Member States, on the one hand, and the States of the European Free Trade Area (EFTA) participating in the European Economic Area, on the other; whereas Article 4 of Protocol 31 provides that the EFTA States participating in the European Economic Area shall, from 1 January 1995, participate in all Community programmes in the field of education, training and youth then in force or adopted;
(31) Overwegende dat de Overeenkomst betreffende de Europese Economische Ruimte voorziet in een uitgebreide samenwerking op het gebied van onderwijs, opleiding en jeugdzaken tussen de Europese Gemeenschap en haar lidstaten enerzijds en de landen van de Europese Vrijhandelsassociatie (EVA) die deelnemen aan de Europese Economische Ruimte anderzijds; dat artikel 4 van protocol nr. 31 bepaalt dat de EVA-landen die deelnemen aan de Europese Economische Ruimte, vanaf 1 januari 1995 deelnemen aan alle programma's van de Gemeenschap op het gebied van onderwijs, opleiding en jeugdzaken die op dat moment lopen of zijn goedgekeurd;
