(7) This Regulation replaces Council Decision 2010/252/EU which was annulled by the Court of Justice of the European Union ('the Court') by its judgment of 5 September 2012 in Case C-355/10. In that judgment, the Court maintained the effects of Decision 2010/252/EU until the entry into force of new rules.

(4) In accordance with Council Decision 2011/167/EU authorising enhanced cooperation in the area of the creation of unitary patent protection, the translation arrangements for European patents with unitary effect should be simple and cost-effective and correspond to those provided for in the proposal for a Council Regulation on the translation arrangements for the European Union patent[28], presented by the Commission on 30 June 2010, combined with the elements of compromise proposed by the Presidency in November 2010 that had wide support in the Council[29].
(4) Overeenkomstig Besluit 2011/167/EU van de Raad houdende machtiging om nauwere samenwerking aan te gaan op het gebied van de instelling van eenheidsoctrooibescherming moeten de vertaalregelingen voor Europese octrooien met eenheidswerking eenvoudig en kosteneffectief zijn en overeenstemmen met die van het voorstel voor een Verordening van de Raad inzake de vertaalregelingen voor het EU-octrooi[28], dat door de Commissie op 30 juni 2010 werd ingediend en werd aangevuld met de door het Voorzitterschap in november 2010 voorgestelde compromiselementen, waarvoor in de Raad brede steun bestond[29].

It is designed to ensure the uniform interpretation and application of that law within the European Union, by offering the courts and tribunals of the Member States a means of bringing before the Court of Justice of the European Union (‘the Court’) for a preliminary ruling questions concerning the interpretation of EU law or the validity of acts adopted by the institutions, bodies, offices or agencies of the Union.

General remark: An analysis of the Court's proposals is rendered difficult by the architecture of the judiciary of the European Union: one 'Court of Justice of the European Union' including the 'Court of Justice', the 'General Court' and 'specialised courts' (up to now only the 'European Union Civil Service Tribunal'), and the fact that the provisions dealing with the structure and functioning of these judicial bodies are spread over four texts, the Treaty on European Union (TEU),the Treaty on the Functioning of the European Union(TFEU), the Statute of the Court (Statute, a protocol to the TFEU) and Rules of Procedure (RoP), all inter-linked with and supplementing each other.

In the European Union, patent protection is currently provided by two systems, neither of which is based on a Community legal instrument: the national patent systems and the European patent system.

On 30 June 2010, the Commission adopted a proposal for a Council Regulation on the translation arrangements for the European Union patent (hereinafter ‘the proposed Regulation on the translation arrangements’) providing for the translation arrangements applicable to the European Union patent.

R. whereas, in particular, this enhanced cooperation may be regarded as furthering the Union's objectives, protecting its interests and reinforcing its integration process within the meaning of Article 20 TEU, in the light of the Commission's impact assessment in connection with its above-mentioned 2010 proposal for a regulation on the translation arrangements for the European Union patent, which pointed to the lack of a unitary patent providing protection across the entire EU leading to a fragmented patent system; whereas this fragmentation is caused by the high costs and complexity of validating European patents in individual Member States, which can amount to 40% of the overall costs of patenting in Europe; whereas the creation of unitary patent protection for a group of Member States would improve the level of patent protection by making it possible to obtain uniform patent protection throughout the territories of the participating Member States and would eliminate the costs and complexity for those territories, thus fostering scientific and technological advances and the functioning of the internal market,

As soon as it has been asked for an opinion within the meaning of Articles 287, 322 or 325 of the Treaty on the Functioning of the European Union, or when it wishes to present observations pursuant to Article 287 of the Treaty on the Functioning of the European Union, the Court shall appoint, from amongst its Members, the Reporting Member with responsibility for appraising the matter and preparing the draft.
2.
