Before the Commission takes any of the decisions provided for in paragraphs 1, 2 and 3 of this Article, it shall examine the case comprehensively in coordination with the bodies respectively mentioned in Article 6(3) and consult the beneficiaries concerned so that they may present their observations within a reasonable time-frame.

For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).
Met het oog op deze hogere voorziening moet in de eerste plaats worden opgemerkt dat het Gerecht voor ambtenarenzaken eraan heeft herinnerd dat elk individueel besluit dat overeenkomstig het Ambtenarenstatuut wordt genomen en dat bezwarend is, met redenen moet worden omkleed, en dat de motiveringsplicht tot doel heeft, enerzijds de rechter in staat te stellen toezicht uit te oefenen op de wettigheid van het besluit en anderzijds aan de betrokkene de noodzakelijke gegevens te verschaffen om uit te maken of het besluit al dan niet gegrond is en hem in staat te stellen te beoordelen of het instellen van beroep opportuun is. I‑3423, punten 24‑28), heeft het hier echter aan toegevoegd dat, wat de besluiten van een jury van een vergelijkend onderzoek betreft, de motiveringsplicht in overeenstemming moet worden gebracht met de eerbiediging van het in artikel 6 van bijlage III bij het Ambtenarenstatuut geformuleerde beginsel volgens hetwelk de werkzaamheden van de jury geheim zijn, welk geheim is ingevoerd teneinde de onafhankelijkheid en onbevangenheid van de jury’s te waarborgen. With regard, in particular, to three-dimensional trade marks consisting of the packaging of goods, such as liquids, which are packaged in trade for reasons linked to the very nature of the product, the Court has held that they must enable average consumers of the goods in question, who are reasonably well informed and reasonably observant and circumspect, to distinguish the product concerned from those of other undertakings without conducting an analytical or comparative examination and without paying particular attention (see, to that effect, with regard to Article 3(1)(b) of First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks (OJ 1989 L 40, p. 1), which provision is identical to Article 7(1)(b) of Regulation No 40/94, Case C‑218/01 Henkel [2004] ECR I‑1725, paragraph 53).

"(14) 'Customs controls' mean specific acts performed by the customs authorities or co-ordinated with them, in order to ensure the correct application of customs legislation and other legislation relating to the import or export of goods, such as examining goods, verifying the existence and authenticity of documents, examining the accounts of undertakings and other records, inspecting means of transport, inspecting luggage and other goods carried by or on persons and carrying out official inquiries and other similar acts with a view to ensuring that customs rules and, where appropriate, other provisions applicable to goods subject to customs supervision are observed.
