For the purposes of Article 29(1)(a) [of the Staff Regulations], when filling a vacant post in the EEAS, the Appointing Authority shall consider the applications of officials of the General Secretariat of the Council [of the European Union], the [European] Commission and the EEAS, of temporary staff to whom Article 2(e) of the Conditions of Employment of Other Servants [of the European Union] applies and of staff from national diplomatic services of the Member States without giving priority to any of those categories.

In the present case, it is clear from paragraphs 48, 51 and 52 of the present judgment that both the duties as described in the vacancy notice and the criterion concerning the level of education required of candidates for the vacant post are equivalent, the former to the duties typically entrusted to officials and other staff in grade AD 5 and the latter to the minimum level of education required for appointment as an official or other staff member in that grade.
In casu blijkt uit de punten 48, 51 en 52 van dit arrest dat van deze overeenstemming sprake is, zowel met betrekking tot de in de kennisgeving van vacature omschreven taken, als met betrekking tot het minimale opleidingsniveau waaraan de kandidaten voor de in de genoemde rang te bezetten post moeten voldoen, waarbij die taken overeenkomen met die welke typisch aan ambtenaren en functionarissen in rang AD 5 worden toevertrouwd, en het opleidingsniveau overeenkomt met het minimale opleidingsniveau dat is vereist om te kunnen worden aangesteld als ambtenaar of functionaris in die rang.

It follows that, in view of the level of higher education required by the vacancy notice in the case of candidates who are staff from the national diplomatic services of the Member States, namely that provided for in Article 5(3)(b)(i) of the Staff Regulations for appointment to grades 5 and 6 in function group AD, and the number of years’ minimum professional experience required, which was only two, candidates who were staff from the national diplomatic services of the Member States, which included the applicant, could not be misled with regard to the grade that corresponded to the vacant post.

Notes the further, minor increase in the number of permanent posts (704 posts in 2009, 700 in 2008 and 695 in 2007) allocated to the EESC, and that the posts are consistently filled (7 vacant posts in 2009, 19 in 2008 and 9 in 2007); notes the presence of the medium-term plan (2008-2013 strategy) to promote equal opportunities and diversity in the secretariat, in particular, through increased use of flexitime arrangements, and looks forward to reports on further advancement in the human resources' policy;

On 22 May 2008 EPSO published in the Official Journal of the European Union (OJ 2008 C 125 A, Spanish language edition, p. 1) notice of open competition EPSO/AD/130/08 (‘the notice of competition’), held in order to draw up a reserve list of lawyer-linguists (Grade AD7) with Spanish as their main language from which to fill vacant posts in the institutions of the European Union, in particular, the Court of Justice of the European Union, the European Parliament and the Council of the European Union.
