‘2. If a customs declaration is made concerning goods listed in Annex II, III, or IIIa and it is confirmed that no authorisation has been granted pursuant to this Regulation for the intended export or import, the customs authorities shall detain the goods declared and draw attention to the possibility to apply for an authorisation pursuant to this Regulation.
2. (22) In order to ensure uniform conditions for the implementation of the provisions concerning the forms for the application for action by the customs authorities and for requesting the extension of the period during which customs authorities are to take action, implementing powers should be conferred on the Commission, namely to establish standard forms. Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules and general principles concerning mechanisms for control by Member States of the Commission's exercise of implementing powers .

The Court of Justice holds that the General Court was justified in finding that the lack of diligence on the part of the Portuguese customs authorities – which rendered the monitoring procedures established by Transnáutica ineffective –gave rise to a special situation justifying the remission of the customs debt.

4. that the customs authorities carry out controls to ensure compliance with regulations in many central policy areas, i.e. consumer security and protection of the financial interests of the Community and the Member States; that they play a fundamental role in combating smuggling, counterfeit, fraud and other illicit activities which comprise crossborder movements of goods; that an important contribution in the customs field to this combat is made within the scope of Article 30 of the Treaty on the European Union; that the Conventions on Mutual Assistance and Cooperation between Customs Administrations (Naples II) and on the use of information technology for customs purposes (Customs Information System) are important new tools for this purpose, and

With regard to customs, it was agreed during the visit that: - Efforts would be made to finalize, by the end of the year, a transit system that would relieve some of the burden on the frontier posts. - The Community and Poland would step up their cooperation and mutual assistance aimed at combating fraud, notably by gradually computerizing customs communications and procedures. - Pilot experiments would be conducted in the next few months with a view to simplifying passage at certain frontier posts. Mrs Scrivener announced that the Community would be continuing the considerable effort already made to train customs officers and improve their qualifications by helping set up a national customs college.
