"public provocation to commit a terrorist offence" means the distribution, or otherwise making available, of a message to the public, with the intent to incite the commission of one of the offences listed in the framework decision, where such conduct, whether or not directly advocating terrorist offences, causes a danger that one or more such offences may be committed; "recruitment for terrorism" means to solicit another person to commit one of the offences listed in the framework decision; and "training for terrorism" means to provide instruction in the making or use of explosives, firearms or other weapons or noxious or hazardous substances, or in other specific methods or techniques, for the purpose of committing one of the offences listed in the framework decision, knowing that the skills provided are intended to be used for this purpose.

Member States conduct peer review of each other's anti-terrorism and security measures, but they still have not managed to make all Member States even implement the 2002 framework decision on terrorism – the very law which makes it obligatory to criminalise terrorism.
De lidstaten beoordelen elkaars maatregelen op het terrein van terrorismebestrijding en veiligheid, maar ze zijn er nog altijd niet in geslaagd alle lidstaten zelfs maar het kaderbesluit uit 2002 over terrorisme ten uitvoer te laten leggen – en dat is nu juist de wet die het verplicht stelt terrorisme strafbaar te stellen.

In this regard the Council urged Member States to finalize within the deadlines set in the Action Plan on Combating Terrorism implementation of the relevant EU/EC legislation (in particular the Framework Decision of 13 June 2002 on the European Arrest Warrant and the Framework Decision of 13 June 2002 on Joint Investigation Teams) as well as the ratification of the relevant conventions (in particular the 2000 Mutual Legal Assistance Convention and its 2001 Protocol, the three Protocols to the Europol Convention as well as all 12 UN Conventions against terrorism).

The Council noted in particular the importance of the political agreement reached on the directive on institutions for occupational retirement provisions (the so-called "pension funds directive"), an important component of the financial services action plan, as well as the final adoption of the Framework Decision on the European arrest warrant which, with the Framework Decision on combating terrorism, is a key component of the measures to combat terrorism. It also highlighted the results achieved in the fields of public contracts, the Regulation on a European cooperative society and the coordination of social security systems. Comments were also noted in the debate on the Industry and Energy Council regarding the proposal for a temporary defensive mechanism for shipbuilding.
De Raad wees met name op het belang van het bereikte politieke akkoord over de richtlijn inzake instellingen voor bedrijfspensioenvoorziening (de "pensioenfondsenrichtlijn", een belangrijk onderdeel van het actieplan voor de financiële diensten, en de definitieve aanneming van het kaderbesluit over het Europees arrestatiebevel dat, samen met het kaderbesluit over de bestrijding van het terrorisme, een kernelement vormt van de maatregelen voor terrorismebestrijding.
