The Commission has, in accordance with the Council directives adopted by Council Decision of 22 April 2013, negotiated amendments to Protocols 1 and 2 to the Agreement between the French Republic, the European Atomic Energy Community and the International Atomic Energy Agency for the Application of Safeguards in Connection with the Treaty for the Prohibition of Nuclear Weapons in Latin America and the Caribbean (‘the amendments to Protocols 1 and 2’).

The conclusion by the European Commission of the amendments to Protocols 1 and 2 to the Agreement between the French Republic, the European Atomic Energy Community and the International Atomic Energy Agency for the Application of Safeguards in Connection with the Treaty for the Prohibition of Nuclear Weapons in Latin America and the Caribbean is hereby approved.

Paragraph I of Protocol 1 to the Agreement between the French Republic, the European Atomic Energy Community and the International Atomic Energy Agency for the Application of Safeguards in Connection with the Treaty for the Prohibition of Nuclear Weapons in Latin America and the Caribbean (‘the Safeguards Agreement’) is replaced by the following:

The Council adopted a decision issuing directives to the Commission for the negotiation of the proposed amendments to Protocols 1 and 2 to the Agreement between the French Republic, the European Atomic Energy Community and the International Atomic Energy Agency for the Application of Safeguards in connection with the Treaty for the Prohibition of Nuclear Weapons in Latin America and the Caribbean.

The European Union expresses its deep concern, as reported by the press on Thursday 24 July, at the statements by the President of the Atomic Energy Organisation of Iran announcing that Iran no longer intends to cooperate with the International Atomic Energy Agency (IAEA) on questions the Agency had raised with it concerning activities that might indicate a possible military dimension to its nuclear programme.

The declaration in Article 1 shall be deposited with the Director-General of the International Atomic Energy Agency, depositary of the Convention, as soon as possible after the entry into force of this Decision by letter signed by the Head of the Delegation of the European Commission to the International Organisations in Vienna, together with the English, French and Spanish versions of the present Decision.

On 2 December 1997 negotiations opened in Luxembourg between the Member States of the European Union and the European Commission on the one hand and the International Atomic Energy Agency on the other hand with a view to concluding three agreements to strengthen the system for verifying the non-proliferation of nuclear weapons.

The Council adopted a Decision approving the conclusion by the Commission of the Agreement between the French Republic, the European Atomic Energy Community and the International Atomic Energy Agency for the application of safeguards in connection with the Treaty for the prohibition of nuclear weapons in Latin America and the Caribbean.
De Raad heeft een besluit aangenomen houdende goedkeuring van de sluiting door de Commissie van de Overeenkomst tussen de Franse Republiek, de Europese Gemeenschap voor Atoomenergie en de Internationale Organisatie voor Atoomenergie inzake de toepassing van waarborgen in het kader van het Verdrag tot verbod van kernwapens in Latijns-Amerika en het Caribisch gebied.

WHEREAS Article III (1) of the Treaty provides that each non-nuclear-weapon State party to the Treaty undertakes to accept safeguards, as set forth in an agreement to be negotiated and concluded with the International Atomic Energy Agency (hereinafter referred to as "the Agency") in accordance with the Statute of the Agency (hereinafter referred to as "the Statute") and the Agency's safeguards system, for the exclusive purpose of verification of the fulfilment of its obligations assumed under this Treaty with a view to preventing diversion of nuclear energy from peaceful uses to nuclear weapons or other nuclear explosive devices;
OVERWEGENDE dat artikel III, lid 1, van het Verdrag bepaalt dat iedere niet-kernwapenstaat die Partij is bij het Verdrag, zich verbindt tot aanvaarding van waarborgen, neergelegd in een overeenkomst waarover zal worden onderhandeld en die zal worden gesloten met de Internationale Organisatie voor Atoomenergie, hierna te noemen "de Organisatie", in overeenstemming met het Statuut van de Organisatie, hierna te noemen "het Statuut", en het waarborgenstelsel daarvan, welke waarborgen uitsluitend verificatie ten doel hebben van de naleving van de verplichtingen die hij ingevolge dit Verdrag op zich heeft genomen ten einde te vermijden, dat kernenergie in plaats van voor vreedzame doeleinden wordt aangewend voor kernwapens of andere nucleaire explosiemiddelen;
