2. By derogation from point (a) of paragraph 1, where the operator demonstrates to the competent authority that for an individual installation the emission limit value for fugitive emissions is not technically and economically feasible, the competent authority may allow emissions to exceed that emission limit value provided that significant risks to human health or the environment are not to be expected and that the operator demonstrates to the competent authority that the best available techniques are being used;

In afwijking van lid 1, onder a), wanneer de exploitant de bevoegde autoriteit het bewijs levert dat de diffuse-emissiegrenswaarde technisch en economisch niet haalbaar is voor een afzonderlijke installatie, kan de bevoegde autoriteit toestaan dat de emissie die emissiegrenswaarde overschrijdt op voorwaarde dat er geen aanmerkelijke gevaren voor de menselijke gezondheid of het milieu zijn te verwachten en de exploitant de bevoegde autoriteit het bewijs levert dat er gebruik wordt gemaakt van de beste beschikbare technieken.
