E. whereas the Council requested on 31 May 2011 that the EU budget continue to fund the GMES programme in line with Union responsibilities, whereas several Member States have already indicated their objection to the funding of GMES being regulated by an intergovernmental agreement, and whereas the proposed GMES Fund will therefore probably not generate the necessary financing;
E. overwegende dat de Raad er op 31 mei 2011 op heeft aangedrongen dat het GMES-programma ook in de toekomst overeenkomstig de verantwoordelijkheden van de Unie uit de EU-begroting wordt gefinancierd, en overwegende dat een aantal lidstaten reeds te kennen heeft gegeven gekant te zijn tegen regelgeving inzake de financiering van het GMES via een intergouvernementele overeenkomst en dat het voorgestelde GMES-Fonds daarom vermoedelijk niet de benodigde kredieten zal opleveren;

4. Points out that uncertainty about the future of the GMES programme and its financing is hugely detrimental to the development and market uptake of GMES services and applications, which are expected to generate economic growth and wellbeing for European citizens;
4. wijst erop dat onzekerheid over de toekomst van het GMES-programma en de financiering daarvan in hoge mate schadelijk is voor de ontwikkeling en aanvaarding door de markt van GMES-diensten en –toepassingen, die naar verwachting economische groei en welzijn voor de Europese burgers zullen opleveren;

(4d) For the purpose of providing for a framework ensuring full and open access to information produced by GMES services and data collected through GMES infrastructure, while providing for the necessary protection of the information produced by the GMES services and of data collected through the GMES dedicated infrastructure, the Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Union in respect of registration and licensing conditions for GMES users and of criteria for restriction of access to GMES data and information, while taking into account the data and information policies of providers of data needed for GMES, and without prejudice to national rules and procedures applicable to space and in situ infrastructures under national control.
(4 quinquies) Teneinde een kader te verstrekken dat een volledige en open toegang verzekert tot de informatie die geproduceerd wordt door de GMES diensten en de data die door middel van de GMES infrastructuur zijn verzameld, daarbij de nodige bescherming verlenend voor voornoemde informatie, moet de Commissie gemachtigd worden om ten aanzien van de voorwaarden voor registratie en vergunning voor GMES-gebruikers en de criteria voor de toegang tot GMES data en informatie gedelegeerde handelingen te verrichten overeenkomstig artikel 209 van het Verdrag inzake de werking van de Europese Unie, daarbij rekening houdend met het data- en informatiebeleid van de providers die voor het GMES benodigde data verstrekken enmet de nationale voorschriften en procedures die van toepassing zijn bij de in de ruimte en in situ geïnstalleerde infrastructuur die zich onder nationale controle bevindt.

2. For the purpose of providing for a framework ensuring the attainment of the GMES information and data policy objective referred to in point (b) of paragraph 1 while providing for the necessary protection of the information produced by the GMES services and of data collected through the GMES dedicated infrastructure, the Commission may adopt, by means of delegated acts in accordance with Article 8a and subject to the conditions of Articles 8b and 8c, the following measures, taking into account the data and information policies of providers of data needed for GMES, and without prejudice to national rules and procedures applicable to space and in situ infrastructures under national control:

Teneinde een kader te verstrekken dat garandeert dat de in punt b) van lid 1 genoemde doelstelling van het informatie- en databeleid wordt bereikt, met inachtneming van de noodzaak van bescherming van de door GMES diensten geproduceerde informatie en de specifiek daartoe bestemde GMES infrastructuur verzamelde data, kan de Commissie, door middel van gedelegeerde handelingen overeenkomstig artikel 8 bis en onder naleving van de voorwaarden gesteld in de artikelen 8 ter en 8 quater, de volgende maatregelen nemen, rekening houdend met het data- en informatiebeleid van de providers van data die nodig zijn oor de GMES, en onverlet de nationale voorschriften en procedures die van toepassing zijn op de ruimtelijke en in situ infrastructuurvoorzieningen die onder nationale controle staan:

(9) In its Communication of 12 November 2008 entitled "Global Monitoring for Environment and Security (GMES): we care for a safer planet", the Commission outlined its approach to the governance and financing of GMES and indicated its intention to delegate technical implementation of GMES to specialised entities, including ESA for the GMES space component owing to its unique position and expertise.
(9) In haar mededeling "Wereldwijde monitoring voor milieu en veiligheid (GMES): voor een veiliger planeet" heeft de Commissie uiteengezet hoe zij de governance en de financiering van GMES wil aanpakken en aangegeven dat het de bedoeling is de technische implementatie van GMES te delegeren aan gespecialiseerde instanties, waaronder voor de GMES-ruimtecomponent het ESA, gezien zijn unieke positie en deskundigheid.
