First ground of appeal — error of law in the grounds of the judgment under appeal, which dismissed as unfounded the appellants’ argument before the General Court to the effect that the decision adopted by the Commission on 8 October 2010 failed to state adequate reasons, in so far as it required the provision of a financial guarantee from a bank with a long-term ‘AA’ credit rating.
Eerste middel: onjuiste rechtsopvatting bij de motivering van het bestreden arrest, waarbij is afgewezen het door rekwiranten in het beroep bij het Gerecht aangevoerde argument inzake het ontbreken van motivering van het besluit van de Commissie van 8 oktober 2010, voor zover daarbij een financiële zekerheid door een bank met een langetermijnrating „AA” werd vereist.

By the first ground of appeal, in the sector of olive oil production, the Hellenic Republic submits that the judgment under appeal manifestly erred in law by reason of the misinterpretation and misapplication of the guidelines contained in the documents AGRI/VI/5330/1997, AGRI/17933/2000 and AGRI/61495/2002, then in force, since it regarded the manifest improvement of the control system in the sector of olive oil production in the 2004-2005 period, as compared with the 2003-2004 period, as repeat offending, continuing weaknesses and marked deterioration justifying an increased correction for the 2004/2005 period, although it was clearly inappropriate to increase the correction from the 10 % which was imposed for the 2003/2004 period to 15 % for the 2004/2005 period on the ground of repeat offending, given that there were numerous improvements (further updating of the Olive cultivation-GIS, improved on-the-spot checks and cross-checks which detect irregularities and impose penalties) which reinforced their control system.

Fourth ground of appeal: Finally, the General Court infringed the duty to provide grounds for its decisions, laid down in Article 81 of the Rules of Procedure of the General Court in conjunction with Articles 36 and 53(1) of the Statute of the Court of Justice, since it is not apparent from the grounds for the judgment under appeal that the General Court addressed the appellant’s claims relating to the inadmissibility of flat-rate financial corrections (first part of the second ground of appeal) or the reasons for rejecting those claims are not apparent.

Third ground of appeal: The judgment under appeal also infringes Article 24(2) of Regulation No 4253/88 in conjunction with the principle of conferred powers, since the General Court appears to have wrongly assumed that the Commission was authorised to make a flat-rate correction (first part of the third ground of appeal).
Het bestreden arrest van het Gerecht is ook in strijd met artikel 24, lid 2, van verordening nr. 4253/88, juncto het beginsel van bevoegdheidstoedeling, doordat het Gerecht ten onrechte lijkt te veronderstellen dat de Commissie bevoegd is om forfaitaire financiële correcties toe te passen (eerste onderdeel van het derde middel).

The second ground of appeal concerns breach of the principles of legal certainty and the protection of legitimate expectations and breach of Article 14 of Regulation (EC) No 659/1999 (1) The bases of this ground of appeal arise from the specific intertemporal circumstances of the case, which were disregarded in the judgment under appeal.

First, the third ground of appeal must be declared inadmissible in so far as it alleges that the Court of First Instance infringed Article 73 of Regulation No 40/94 by not annulling the decision in dispute for being based on grounds on which the appellant had not had an opportunity to present its comments.

First, in so far as it criticises the Court of First Instance for failing to take into account the evidence summarised at paragraphs 18, 19, 21 and 22 of the contested judgment, the third ground of appeal is indissociable from the second ground and must therefore be rejected for the same reasons.
