The Framework Directive on Health and Safety in the Workplace (89/391/EEC)[xliii], while not explicitly referring to tobacco smoke, covers all risks to the health and safety of workers[xliv] It requires the individual employer to assess the risks in the workplace and to introduce appropriate risk prevention and protection measures.
Kaderrichtlijn 89/391/EEG over veiligheid en gezondheid op het werk [xliii] gaat weliswaar niet expliciet in op tabaksrook maar geldt wel voor alle risico’s voor de veiligheid en gezondheid van werknemers[xliv]. Deze richtlijn verplicht de individuele werkgever om de risico’s op de werkplek te evalueren en gepaste preventie- en beschermingsmaatregelen te treffen.

Stresses the crucial significance of mainstreaming, i.e. the incorporation of gender issues into activities and analyses in the field of health and safety at the workplace, and notes that the 'Community health and safety strategy' promotes the incorporation of the gender dimension into health and safety at work; calls on the Member States to implement and promote that dimension systematically and effectively;

In order to improve the working environment, as regards the protection of the safety and health of workers as provided for in the Treaty and successive Community strategies and action programmes concerning health and safety at the workplace, the aim of the Agency shall be to provide the Community bodies, the Member States, the social partners and those involved in the field with the technical, scientific and economic information of use in the field of safety and health at work’.

The Common Principles for Inspection of Health and Safety at the workplace established by SLIC should be the foundation for reaching effective and uniform enforcement of the EU Health and Safety legislation and avoiding competitive advantages for some companies.
Aan de hand van de gemeenschappelijke beginselen voor de inspectie van de gezondheid en veiligheid op de werkplek, die door het CHFA zijn opgesteld, moet een effectieve en uniforme handhaving van de gezondheids- en veiligheidswetgeving van de EU worden bereikt en dient te worden voorkomen dat bepaalde bedrijven concurrentievoordelen genieten.
