In its Resolution of 10 September 2013 on online gambling in the internal market, the European Parliament (3) called on the Commission to explore the possibility of interoperability between national self-exclusion registers, to raise awareness about the risks of gambling addiction and to consider compulsory third-party identification checks.

In order to be able to use the date of these checks to determine the period of validity of the identification document for further movement within the Union, Member States should be required to record proof of the checks in the identification document.

(23) In order to ensure uniform conditions for the implementation of Regulation (EC) No 1760/2000 with respect to the registration of holdings making use of alternative means of identification, technical characteristics and modalities for the exchange of data between the computerised databases of Member States, the declaration that the data exchange system between Member States is fully operational, the format and design of the means of identification, technical procedures and standards for the implementation of EID, the format of the passports and of the register to be kept on each holding, rules concerning the modalities for the application of the sanctions imposed by the Member States on holders pursuant to Regulation (EC) No 1760/2000, corrective actions to be taken by the Member States to ensure proper compliance with Regulation (EC) No 1760/2000, in cases where on-the-spot checks so justify, and the necessary rules to ensure proper compliance in particular as regards controls, administrative sanctions, and various maximum periods laid down in this Regulation, implementing powers should be conferred on the Commission.

The checks shall be carried out, in principle, prior to identification for VAT purposes or, where only preliminary checks are conducted before such identification, no later than six months from such identification.

Het ontbreken van een verwijzing naar de identificatie in de verordening is te wijten aan het feit dat destijds geen overeenstemming bestond over welke methoden het meest doeltreffend waren om de echtheid van eurobiljetten en -munten op grote schaal te controleren.

Article 14 of Council Directive 91/496/EEC of 15 July 1991 laying down the principles governing the organisation of veterinary checks on animals entering the Community from third countries (5) states that the identification and registration provided for in Article 3(1)(c) of Directive 90/425/EEC of such animals must, except in the case of animals for slaughter and registered equidae, be carried out after the said checks have been made.

Consideration should be given as to whether the criminalisation of gross negligence in the failure to comply with reporting obligations and other obligations such as the carrying out of adequate identification checks, record keeping and co-operation with FIUs, including the possibility of corporate liability in appropriate circumstances, would improve the effectiveness of this aspect of anti-money laundering rules.

With regard to the checks provided for in Article 36(2), the report shall include, inter alia, the identification numbers, the carcass weights and the dates of slaughter in relation to all animals slaughtered and checked on the day of the on-the-spot check.
