(45) In order to ensure uniform conditions for the implementation of this Regulation as regards imports, implementing powers should also be conferred on the Commission in respect of measures laying down fixed quantities of agricultural products considered to have been used in the manufacturing of the processed agricultural products for the purposes of the reduction or phasing out of import duties applicable in preferential trade and establishing the appropriate documentary requirements, the annual tariff quotas and the method of administration to be used for the import of processed agricultural products and certain agricultural products in accordance with the Union's international commitments, procedures for the application of specific provisions laid down in international agreements or acts adopting the import or export regime in particular on the guarantees covering the nature, provenance and origin of the product, recognition of the document used for verifying these guarantees , the presentation of a document issued by the exporting country and on the destination and use of the products , measures laying down the period of validity of import licences, the procedure for lodging a security and its amount, the use of those import licences and, where necessary, the specific measures relating to, in particular, the conditions under which applications for import are to be submitted and authorisation granted within the tariff quota and the appropriate documentary requirements.

The provisions of Commission Regulation (EC) No 612/2009 of 7 July 2009 on laying down common detailed rules for the application of the system of export refunds on agricultural products and of Commission Regulation (EC) No 376/2008 of 23 April 2008 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products and Commission Regulation (EC) No 382/2008 of 21 April 2008 on rules of application for import and export licences in the beef and veal sector must be interpreted as precluding, as a rule, the payment of an export refund and the release of the security lodged in that connection when the exporter concerned did not have a valid export licence at the date the export declaration was accepted, even though the actual export of the goods concerned took place during the period of validity of the export licence issued to it.
De bepalingen van verordening (EG) nr. 612/2009 van de Commissie van 7 juli 2009 houdende gemeenschappelijke uitvoeringsbepalingen van het stelsel van restituties bij uitvoer voor landbouwproducten, en die van verordening (EG) nr. 376/2008 van de Commissie van 23 april 2008 houdende gemeenschappelijke uitvoeringsbepalingen inzake het stelsel van invoer-, uitvoer- en voorfixatiecertificaten voor landbouwproducten en verordening (EG) nr. 382/2008 van de Commissie van 21 april 2008 houdende uitvoeringsbepalingen voor de invoer- en uitvoercertificatenregeling in de sector rundvlees, moeten aldus worden uitgelegd dat zij zich in beginsel verzetten tegen de betaling van een uitvoerrestitutie en de vrijgave van de in dat verband gestelde zekerheid wanneer de betrokken exporteur op de datum van aanvaarding van de aangifte ten uitvoer niet beschikte over een geldig uitvoercertificaat, ook al vond de feitelijke uitvoer van de betrokken goederen plaats tijdens de geldigheidsduur van het aan hem afgegeven uitvoercertificaat.

11. The Commission shall advise the exporters, importers and representative associations of importers or exporters known to it to be concerned, as well as representatives of the exporting country and the complainants, of the initiation of the proceedings and, with due regard to the protection of confidential information, provide the full text of the written complaint received pursuant to paragraph 1 to the known exporters and to the authorities of the exporting country, and make it available upon request to other interested parties involved.

13. Member States shall, within the period laid down in the notice opening the quota concerned, inform the Commission of the number and the aggregate amount of the import or export applications, broken down into those from traditional importers or exporters and other importers or exporters, and of the amount of the previous imports or exports carried out by the applicants during the reference period.

An import or export licence confers the right to import or export and so it must be presented at the time when the import or export declaration is accepted.

They shall be achieved by facilitating information exchange about the characteristics of such chemicals, by providing for a decision-making process within the Community on their import and export and by disseminating decisions to Parties and other countries as appropriate.
