(11) Whereas, because of the specific situation of students, it has not been possible to set up a comprehensive system for the coordination of the social security rights of students at Community level, in particular in respect of invalidity benefits; whereas social security benefits available to students vary greatly between Member States particularly with regard to special non-contributory benefits designed to help towards the additional costs arising from the care and mobility needs of disabled people; whereas the Court of Justice of the European Communities has recognised that the detailed rules for granting certain benefits are closely linked to a particular economic and social context; whereas a limited derogation from the rules on the coordination of periods applied by Article 10a(2) of Regulation (EEC) No 1408/71 is therefore justified;
(11) Overwegende dat het vanwege de specifieke situatie van studenten niet mogelijk is geweest een alomvattend stelsel voor de coördinatie van de rechten van studenten op het gebied van sociale zekerheid op communautair niveau op te zetten, met name wat betreft de invaliditeitsuitkeringen voor studenten; dat de socialezekerheidsuitkeringen waarvoor studenten in aanmerking komen, van lidstaat tot lidstaat aanzienlijk uiteenlopen, met name wat betreft de speciale niet op premie- of bijdragebetaling berustende prestaties die bedoeld zijn als bijdrage in de bijkomende kosten die voortvloeien uit de behoeften aan verzorging en mobiliteit van gehandicapten; dat het Hof van Justitie heeft erkend dat gedetailleerde voorschriften voor het toekennen van bepaalde uitkeringen nauw verbonden zijn met een specifieke economische en sociale context; dat een beperkte afwijking van de voorschriften inzake de coördinatie van tijdvakken zoals bedoeld in artikel 10 bis, lid 2, derhalve gerechtvaardigd is;
