Directive 2005/29/EC of the European Parliament and of the Council of 11 May 2005 concerning unfair business-to-consumer commercial practices in the internal market and amending Council Directive 84/450/EEC, Directives 97/7/EC, 98/27/EC and 2002/65/EC of the European Parliament and of the Council and Regulation (EC) No 2006/2004 of the European Parliament and of the Council (‘Unfair Commercial Practices Directive’) must be interpreted as meaning that the communication, by a professional to a consumer, of erroneous information, such as that at issue in the main proceedings, must be classified as a ‘misleading commercial practice’, within the meaning of that directive, even though that information concerned only one single consumer;
Richtlijn 2005/29/EG van het Europees Parlement en de Raad van 11 mei 2005 betreffende oneerlijke handelspraktijken van ondernemingen jegens consumenten op de interne markt en tot wijziging van richtlijn 84/450/EEG van de Raad, richtlijnen 97/7/EG, 98/27/EG en 2002/65/EG van het Europees Parlement en de Raad en van verordening (EG) nr. 2006/2004 van het Europees Parlement en de Raad („richtlijn oneerlijke handelspraktijken”) moet aldus worden uitgelegd dat de verstrekking van onjuiste informatie door een handelaar aan een consument, zoals die welke in het hoofdgeding aan de orde is, moet worden aangemerkt als „misleidende handelspraktijk” in de zin van die richtlijn, ook al had die verstrekking van informatie slechts op één consument betrekking.

Article 54(1) and (2) of Directive 2004/39/EC of the European Parliament and of the Council of 21 April 2004 on markets in financial instruments amending Council Directives 85/611/EEC and 93/6/EEC and Directive 2000/12/EC of the European Parliament and of the Council and repealing Council Directive 93/22/EEC must be interpreted as meaning that, in administrative proceedings, a national supervisory authority may rely on the obligation to maintain professional secrecy against a person who, in a case not covered by criminal law and not in a civil or commercial proceeding, requests it to grant access to information concerning an investment firm which is in judicial liquidation, even where that firm’s main business model consisted in large scale fraud and wilful harming of investors’ interests and several executives of that firm have been sentenced to terms of imprisonment.

However, based on the information available, it is concluded that overall the whole Union industry was in a poor situation and the fact that the number of business models has spread did not cause any injury to the Union industry and should rather be interpreted as a way to compensate decreasing sales on the Union market.
Op basis van de beschikbare informatie wordt geconcludeerd dat de bedrijfstak van de Unie in het algemeen in een slechte staat verkeerde en dat de uitbreiding van het aantal ondernemingsmodellen de bedrijfstak geen schade berokkende maar juist moet worden gezien als een manier om de dalende verkoop op de markt van de Unie te compenseren.

Where guidance is given by national competent authorities as regards the obligations either to reject all transfers from a payment service provider which regularly fails to supply the required information on the payer or to decide whether or not to restrict or terminate a business relationship with that payment service provider, it should inter alia be based on the convergence of best practices and should also take into account the fact that the revised interpretative note to SR VII of the FATF allows third countries to set a threshold of EUR 1 000 or USD 1 000 for the obligation to send information on the payer, without prejudice to the objective of efficiently combating money laundering and terrorist financing.

Points out that the difficulties raised by the application of the Posting of Workers Directive are related partly to the fact that it has not been transposed by all the Member States, and calls on the Commission to keep Parliament informed of the progress of infringement proceedings against defaulting Member States; and also draws attention to the difficulties of implementing the Posting of Workers Directive as a result of differences of interpretation of certain key concepts, such as worker, minimum salary, and subcontracting, the difficulty of both workers and small businesses in obtaining information, and the difficulty of monitoring compliance with the directive;
2. wijst erop dat de problemen die de toepassing van de detacheringsrichtlijn oplevert deels te maken hebben met het feit dat de richtlijn niet in alle lidstaten is omgezet en verzoekt de Commissie daarom het Parlement op de hoogte te houden van het verloop van de inbreukprocedures; wijst erop dat de uitvoering van de richtlijn ook bemoeilijkt wordt door verschillende interpretaties van enkele sleutelbegrippen (werknemer, minimumloon, onderaanneming), de moeite voor werknemers en KMO's om aan informatie te komen, alsook problemen met het toezicht op de naleving van de richtlijn;
