M. whereas only two Member States (Germany and the United Kingdom) have replied to the follow-up letters sent to eight Member States (France, Germany, Italy, Lithuania, Poland, Romania, Sweden and the United Kingdom) by the UN Special Procedures, requesting additional information following the UN Joint Study on global practices in relation to secret detention in the context of countering terrorism;
M. overwegende dat slechts twee lidstaten (Duitsland en het Verenigd Koninkrijk) hebben geantwoord op de follow‑upbrieven die de Dienst speciale procedures van de VN aan acht lidstaten (Frankrijk, Italië, Litouwen, Polen, Roemenië, Zweden en het Verenigd Koninkrijk) heeft gestuurd, en waarin om bijkomende informatie werd verzocht naar aanleiding van de VN-studie over wereldwijde praktijken inzake geheime detentie in het kader van terrorismebestrijding;

43. Reiterates its call, in accordance with international law, in particular Article 12 of the CAT, for all states faced with credible allegations to make every effort to provide the necessary clarification and, if the indications persist, to conduct thorough investigations and inquiries into all alleged acts of extraordinary rendition, secret prisons, torture and other serious human rights violations, so as to establish the truth and, if necessary, determine responsibility, ensure accountability and avoid impunity, including by bringing individuals to justice where there is evidence of criminal liability; calls on the VP/HR and the Member States, in this connection, to take all the necessary measures to ensure proper follow-up to the UN Joint study on global practices in relation to secret detention in the context of countering terrorism, in particular with regard to the follow-up letter sent to 59 states by the Special Procedures mandate-holders on 21 October 2011, asking their respective governments to provide an update on the implementation of the recommendations contained in that study;
43. herhaalt zijn oproep aan alle staten waartegen geloofwaardige beschuldigingen zijn ingebracht om, zoals vereist door internationale wetgeving en met name artikel 12 van het Verdrag ter voorkoming van foltering, alles in het werk te stellen om de nodige opheldering te verschaffen en om, wanneer de aanwijzingen steekhoudend blijken, grondig onderzoek te doen naar en inlichtingen in te winnen over alle veronderstelde buitengewone uitleveringen, geheime gevangenissen, gevallen van foltering en andere ernstige mensenrechtenschendingen, om zo tot waarheidsvinding te komen en zo nodig de verantwoordelijkheid te vast te stellen, de verantwoordingsplicht te waarborgen en straffeloosheid te voorkomen, wat tevens inhoudt dat in geval van aantoonbare strafrechtelijke aansprakelijkheid ook berechting dient plaats vinden; verzoekt de hoge vertegenwoordiger/vicevoorzitter en de lidstaten in dit verband de nodige maatregelen te treffen om ervoor te zorgen dat de gezamenlijke studie van de VN inzake mondiale praktijken met betrekking tot geheime detentie een toereikende follow-up krijgt, met name wat betreft de follow-upbrief die op 21 oktober 2011 door de houders van speciale mandaten naar 59 landen werd gestuurd en waarin de respectieve regeringen verzocht werden om actuele informatie te verschaffen over de tenuitvoerlegging van de aanbevelingen uit die studie;

5. 5. herhaalt haar oproep aan alle staten waartegen geloofwaardige beschuldigingen bestaan om, zoals vereist door internationale wetgeving en met name artikel 12 van het CAT, alles in het werk te stellen om de nodige opheldering te verschaffen en om, wanneer de aanwijzingen steekhoudend blijken, grondig onderzoek te doen naar en inlichtingen in te winnen over alle veronderstelde handelingen van buitengewone uitlevering, geheime gevangenissen, foltering en andere ernstige mensenrechtenschendingen, om zo de waarheid vast te stellen en zo nodig de verantwoordelijkheid te bepalen, de verantwoordingsplicht te waarborgen en straffeloosheid te voorkomen, wat tevens inhoudt dat daar waar bewijs is voor strafrechtelijke aansprakelijkheid individuen ook worden berecht; verzoekt in dit verband de HV/VP en de lidstaten van de EU de nodige maatregelen te treffen om ervoor te zorgen dat de gezamenlijke studie van de VN inzake mondiale praktijken met betrekking tot geheime detentie een toereikende follow-up krijgt, met name wat betreft de follow-upbrief die op 21 oktober 2011 door de houders van speciale mandaten naar 59 landen werd gestuurd en waarin de respectieve regeringen verzocht werden om actuele informatie te verschaffen over de tenuitvoerlegging van de aanbevelingen uit die studie;

12. Welcomes the ‘Joint study on global practices in relation to secret detention in the context of countering terrorism’, which will be discussed at the 13th session; calls on the EU Members States to support it and to provide adequate follow-up to the report, in line with the previous stances of the European Parliament on the issue, especially its resolutions of 19 February 2009 and 14 February 2007 on the alleged use of European countries by the CIA for the transportation and illegal detention of prisoners; deplores attempts to censor the study and prevent its consideration by the Human Rights Council;
12. is blij met de 'joint study on global practises in relation to secret detention in the context of countering terrorism', die tijdens de dertiende zitting zal worden besproken; verzoekt de lidstaten van de EU het verslag te steunen en voor passende follow-up ervan te zorgen, overeenkomstig de eerdere resoluties van het Europees Parlement over dit onderwerp, in het bijzonder zijn resoluties van 19 februari 2009 en 14 gebruari 2007 over het veronderstelde gebruik door de CIA van Europese landen voor het vervoer en illegaal vasthouden van gevangenen; betreurt het feit dat is geprobeerd het verslag te censureren en de behandeling ervan in de UNHCR te voorkomen;
