Further, although box 7 of the impugned enforcement Instrument states that the date ‘of notification of the initial instrument permitting enforcement’ was 15 July 2009 (which corresponds to the date of publication of the disputed claim in the Official Journal of Greece), it is stated in the written observations of the Greek Government that the parallel attempt at notification on the plaintiff via its embassy in Dublin was not successful.
Bovendien wordt, hoewel in vak 7 van de betwiste executoriale titel staat dat de datum „van notificatie van de oorspronkelijke executoriale titel” 15 juli 2009 is (wat overeenkomt met de datum van bekendmaking van de betwiste schuldvordering in het publicatieblad van Griekenland), in de schriftelijke opmerkingen van de Griekse regering gesteld dat de parallelle poging tot notificatie aan verzoeker via haar ambassade te Dublin niet is geslaagd.
