29. The EDPS, which has 24 posts in service requested 5 new posts of which 3 were accepted. This resulted in a decrease in expenditure of EUR 202 819. Furthermore, the appropriation allocated to auxiliary staff under item 1110 ("Auxiliary staff, local staff and special advisers") was reduced by around 50%, resulting in a further reduction of EUR 30 000.

Auxiliary staff of the European Communities may opt to be subject to the legislation of the Member State in which they are employed, to the legislation of the Member State to which they were last subject or to the legislation of the Member State whose nationals they are, in respect of provisions other than those relating to family allowances, provided under the scheme applicable to such staff.

Where an auxiliary staff member or assistant to Members of the European Parliament , employed in the territory of a Member State other than Germany, has opted for German legislation to be applied, the provisions of that legislation shall be applied as though the auxiliary staff member or assistant were employed in the place where the German Government has its seat or as though the auxiliary staff member or assistant were employed in the place in which he had last been permanently resident in Germany.
4. Indien de hulpfunctionaris of de medewerker van een lid van het Europees Parlement, die op het grondgebied van een andere lidstaat dan de Bondsrepubliek Duitsland werkzaam is, voor toepassing van de Duitse wetgeving heeft gekozen, wordt deze wetgeving toegepast alsof de hulpfunctionaris of de medewerker van een lid van het Europees Parlement ter plaatse waar de Duitse regering haar zetel heeft, werkzaam was of alsof de betrokkene werkzaam was op de plaats waar hij of zij in de Bondsrepubliek Duitsland zijn of haar laatste permanente woonplaats had .

Where an auxiliary staff member or European Parliament assistant, employed in the territory of a Member State other than Germany, has opted for German legislation to be applied, the provisions of that legislation shall be applied as though the auxiliary staff member or European parliamentary assistant were employed in the place where the German Government has its seat or as though the auxiliary staff member or European parliamentary assistant were employed in the place in which he had last been permanently resident in Germany.
