4. The application of the present Agreement shall be without prejudice to the rights and procedural guarantees for persons applying for asylum as provided by Council Directive 2003/9/EC laying down minimum standards for the reception of asylum seekers (6) and by Council Directive 2005/85/EC on minimum standards on procedures in Member States for granting and withdrawing refugee status (7) and in particular with regard to the right to remain in the Member Sate pending the examination of the application.
4. (24) In order to cover any improvements in minimum standards for the reception of asylum seekers, there should be a proportionate increase in the funds made available by the European Union in order to cover the costs of such improvements, especially in the case of Member States which are facing specific and disproportionate pressures on their national asylum systems, owing in particular to their geographical or demographic situation.

12. Member States shall ensure that asylum-seekers detained in accordance with this Article enjoy the same level of reception conditions for detained applicants as those laid down in particular in Articles 10 and 11 of Directive [././EC] [laying down minimum standards for the reception of asylum seekers].

Moreover, the proposal aims to ensure consistency with developments in the EU asylum acquis , in particular with the Asylum Procedures Directive, with the Qualification Directive, and with the Council Directive 2003/9/EC on minimum standards for the reception of asylum seekers (hereafter: the Reception Conditions Directive)[11].

On 27 January 2003, the Council adopted Directive 2003/9/EC laying down minimum standards for the reception of asylum seekers.[1] It is applicable to all Member States except Ireland and Denmark[2] and was designed to harmonise the laws of the Member States concerning the reception conditions applicable to asylum seekers, thus contributing to the establishment of an EU-wide level playing field in the area of asylum and to reduce secondary movements.
