TRADUCTIONS EN CONTEXTE

1. In order to address the failures of the European financial supervision revealed by the recent financial crisis, the Commission presented a package of proposals in view of the establishment of a more efficient, more integrated and sustainable system of financial supervision in the EU. This will be based on a an European System of Financial Supervisors (ESFS), consisting of a network of national financial supervisors working in tandem with new European Supervisory Authorities (ESAs), created by transforming the existing European supervisory committees into real European Supervision Authorities (ESAs).

Om de tekortkomingen aan te pakken van het Europese financiële toezicht die door de recente financiële crisis zijn blootgelegd, heeft de Commissie een pakket voorstellen ingediend voor de instelling van een efficiënter, geïntegreerder en duurzamer systeem voor financieel toezicht in de EU. Dit zal gebaseerd zijn op een Europees Systeem van financiële toezichthouders (ESFT), bestaande uit een netwerk van nationale financiële toezichthouders die samenwerken met nieuwe Europese toezichthoudende autoriteiten (ETA's), die worden gecreëerd door de bestaande Europese toezichthoudende comités tot echte ETA's om te vormen.

Following the conclusions of the report of the High-Level Group on Financial Supervision in the EU (the ‘de Larosière report’), the Commission put forward concrete legislative proposals on 23 September 2009 in order to establish a European System of Financial Supervisors comprising a network of national financial supervisors working in tandem with new European supervisory authorities.
In aansluiting op de conclusies in het verslag van de groep op hoog niveau over financieel toezicht in de Europese Unie (het de Larosière-verslag) heeft de Commissie op 23 september 2009 concrete wetgevingsvoorstellen ingediend voor de oprichting van een Europees systeem van financiële toezichthouders, dat bestaat uit een netwerk van nationale financiële toezichthouders die samenwerken met de nieuwe Europese toezichthoudende autoriteiten.

The European System of Financial Supervision (hereinafter the ESFS’) should be designed to overcome those deficiencies and provide a system that is in line with the objective of a stable and single Union financial market for financial services, linking national supervisors within a strong Union network.
Met de oprichting van het Europees Systeem voor financieel toezicht (European System of Financial Supervision - ESFS) wordt beoogd deze tekortkomingen te verhelpen en te komen tot een systeem dat aansluit bij de doelstelling om in de Unie een stabiele interne markt voor financiële diensten tot stand te brengen en dat de nationale toezichthouders verenigt in een sterk Unienetwerk.

The delegation of tasks and responsibilities can be a useful instrument in the functioning of the network of supervisors in order to reduce the duplication of supervisory tasks, to foster cooperation and thereby streamline the supervisory process, as well as to reduce the burden imposed on financial market participants.
De delegatie van taken en verantwoordelijkheden kan in verband met de werking van het netwerk van toezichthouders een nuttig instrument zijn om overlapping in toezichttaken te vermijden, om samenwerking te bevorderen en aldus het toezichtproces te stroomlijnen alsmede om de last die aan de financiëlemarktdeelnemers wordt opgelegd, te verminderen.

5. In order to ensure consistency in implementation of the measures referred to in paragraphs 2, 3 and 4, the Commission may, following consultation with the European Network and Information Security Agency (ENISA), the Working Party on the Protection of Individuals with regard to the Processing of Personal Data established by Article 29 of Directive 95/46/EC and the European Data Protection Supervisor, adopt technical implementing measures concerning the circumstances, format and procedures applicable to the information and notification requirements referred to in this Article.
5. Teneinde een samenhangende tenuitvoerlegging van de in de leden 2, 3 en 4 bedoelde maatregelen te waarborgen, kan de Commissie, na raadpleging van het Europees Agentschap voor netwerk- en informatiebeveiliging (ENISA), de bij artikel 29 van Richtlijn 95/46/EG ingestelde werkgroep voor de bescherming van personen in verband met de verwerking van persoonsgegevens en de Europese Toezichthouder voor gegevensbescherming, technische uitvoeringsmaatregelen aannemen in verband met, onder meer, de omstandigheden, het formaat en de procedures die gelden voor de in dit artikel bedoelde informatieverstrekkings- en kennisgevingseisen.

When adopting implementing measures on security of processing, the Commission should consult all relevant European authorities and organisations (the European Network and Information Security Agency (ENISA), the European Data Protection Supervisor and the Working Party on the Protection of Individuals with regard to the Processing of Personal Data established by Article 29 of Directive 95/46/EC), as well as all other relevant stakeholders, particularly in order to be informed of the best available technical and economic means of improving the implementation of Directive 2002/58/EC (Directive on privacy and electronic communications).
Bij het aannemen van de uitvoeringsmaatregelen inzake de veiligheid van de verwerking moet de Commissie alle betrokken Europese overheden en organisaties (het Europees Agentschap voor netwerk- en informatiebeveiliging (ENISA), de Europese Toezichthouder voor gegevensbescherming en de werkgroep voor de bescherming van personen in verband met de verwerking van persoonsgegevens ingesteld overeenkomstig artikel 29 van Richtlijn 95/46/EG), alsmede alle andere relevante belanghebbenden raadplegen, met name om informatie in te winnen over de beste beschikbare technische en economische methoden om de toepassing van Richtlijn 2002/58/EG (richtlijn betreffende privacy en elektronische communicatie) te verbeteren.

60. Welcomes the cooperation among national supervisory authorities aimed at putting supervisory resources to better use, developing supervisory practice, and lightening the burden that supervision imposes on the market; is positive about colleges of supervisors dealing with multi-jurisdictional financial conglomerates, and about the operational networking project that CEBS has recently initiated; calls on the colleges of supervisors to foster a common European supervisory culture and to determine exactly where the limits of such voluntary cooperation lie when real crisis situations appear; notes, however, that these colleges lack the national mandates to transfer competences, to accept majority decisions, or simply to put sufficient resources and expertise into the colleges' work; points out, therefore, the necessity of defining a framework and national mandates for cooperation and expects the colleges of supervisors and the operational networking project to provide necessary practical solutions (memoranda of understanding) for the supervision of cross-border groups within a short time frame;
