Initially, the Annex XV dossier indicated that exposure to nonylphenol (‘NP’) and nonylphenol ethoxylates (‘NPE’) posed a risk to the environment, specifically to aquatic species living in surface water.

In the Annex XV dossier NPE are defined as branched and linear ethoxylates of nonylphenol which cover substances defined by CAS or EC numbers and UVCB substances, polymers and homologues.

However national authorisations for pesticides or biocidal products containing nonylphenol ethoxylates as co-formulant, granted before 17 July 2003, shall not be affected by this restriction until their date of expiry.
In het geval van vóór 17 juli 2003 verleende nationale toelatingen voor gewasbeschermingsmiddelen of biociden die nonylfenolethoxylaten als co-formulant bevatten, geldt deze beperking echter pas vanaf het verstrijken van de toelating.

(9) Ditallow-dimethyl-ammonium-chloride (DTDMAC) and nonylphenol (including ethoxylates derivatives-APEs) are priority substances undergoing at Community level risk assessment activities, in accordance with Council Regulation (EEC) No 793/93 of 23 March 1993 on the evaluation and control of the risks of existing substances(11), and if necessary adequate strategies to limit the risks of exposure to these substances should therefore be recommended and implemented in the framework of other Community provisions.
