In the case of chemicals listed in Part 2 of Annex I that are to be exported to OECD countries, the designated national authority of the exporter’s Member State may, at the request of the exporter, in consultation with the Commission and on a case-by-case basis, decide that no explicit consent is required if the chemical, at the time of importation into the OECD country concerned, is licensed, registered or authorised in that OECD country.
Voor chemische stoffen die in deel 2 van bijlage I zijn opgenomen en naar OESO-landen worden uitgevoerd, kan de aangewezen nationale instantie van de lidstaat van de exporteur, op verzoek van de exporteur, in overleg met de Commissie en per geval beslissen dat er geen uitdrukkelijke toestemming nodig is als voor de chemische stof ten tijde van de invoer naar het betrokken OESO-land een vergunning, registratie of toelating is verleend in dat OESO-land.

2. WEEE exported out of the Community in line with Regulation (EC) No 1013/2006 on shipments of waste Council Regulation (EEC) No 259/93, and Commission Regulation (EC) No 1418/2007 of 29 November 2007 concerning the export for recovery of certain waste listed in Annex III or Annex IIIA to Regulation (EC) No 1013/2006 of the European Parliament and of the Council to certain countries to which the OECD Decision on the control of transboundary movements of wastes does not apply [26] Council Regulation (EC) No 1420/1999 [27] of 29 April 1999 establishing common rules and procedures to apply to shipments to certain non-OECD countries of certain types of waste and Commission Regulation (EC) No 1547/1999 [28] of 12 July 1999 determining the control procedures under Council Regulation (EEC) No 259/93 to apply to shipments of certain types of waste to certain countries to which OECD Decision C(92)39 final does not apply, shall only count for the fulfilment of obligations and targets of Article 117(1) and (2) of this Directive if the exporter can prove that the treatment recovery, re-use and/or recycling operation took place under conditions that are equivalent to the requirements of this Directive.

An amendment adopted in 1995, which has not yet entered into force, establishes a ban on exports of hazardous waste from EU and OECD member countries to non-OECD countries.
In 1995 is een amendement aangenomen, dat echter nog niet in werking is getreden, dat de uitvoer van gevaarlijke afval uit EU- en OESO-lidstaten naar niet-OESO-lidstaten verbiedt.

An absolute ban on exports of hazardous waste from OECD countries to non-OECD countries was adopted in 1995 as an amendment to the Basel Convention.

One of the amendments to this Convention adopted in 1995 banned exports of hazardous waste from OECD countries to non-OECD countries.
In 1995 is een amendement op het verdrag goedgekeurd waardoor geen gevaarlijke afvalstoffen meer zouden mogen worden overgebracht van een land dat lid is van de Organisatie voor Economische Samenwerking en Ontwikkeling (OESO) naar een land dat geen OESO-lid is.

The export of such vessels from the EU to a non-OECD country for dismantling is therefore prohibited. These vessels must be processed in an OECD country under environmentally sound conditions or decontaminated so that they no longer constitute hazardous waste.
De uitvoer van dergelijke schepen vanuit de EU naar een land dat geen lid is van de OESO om daar te worden ontmanteld, is dan ook verboden: het schip moet eerst op milieuhygiënisch verantwoorde wijze worden behandeld in een OESO-land of worden gesaneerd zodat het niet om gevaarlijk afval gaat.
