Given that no significant quantities of the chemical are expected to reach humans and the environment during the production and use of a closed-system site-limited intermediate, a Party, upon notification to the Secretariat, may allow the production and use of quantities of a chemical listed in this Annex as a closed-system site-limited intermediate that is chemically transformed in the manufacture of other chemicals that, taking into consideration the criteria in paragraph 1 of Annex D, do not exhibit the characteristics of persistent organic pollutants.

3. Each Party that has one or more regulatory and assessment schemes for new pesticides or new industrial chemicals shall take measures to regulate with the aim of preventing the production and use of new pesticides or new industrial chemicals which, taking into consideration the criteria in paragraph 1 of Annex D, exhibit the characteristics of persistent organic pollutants.
3. Elke partij die een of meerdere systemen heeft voor regelgeving en beoordeling van nieuwe pesticiden of nieuwe industriële chemische stoffen, neemt maatregelen ter regulering ter voorkoming van de productie en het gebruik van nieuwe pesticiden of nieuwe industriële chemische stoffen die, met inachtneming van de in bijlage D, punt 1, bedoelde criteria, de kenmerken van persistente organische verontreinigende stoffen bezitten.

3. Member States and the Commission shall, within the assessment and authorisation schemes for existing and new chemicals and pesticides under the relevant Community legislation, take into consideration the criteria set out in paragraph 1 of Annex D to the Convention and take appropriate measures to control existing chemicals and pesticides and prevent the production, placing on the market and use of new chemicals and pesticides, which exhibit characteristics of persistent organic pollutants.
3. De lidstaten en de Commissie houden, binnen de beoordelings- en vergunningsregelingen voor bestaande en nieuwe chemische stoffen en bestrijdingsmiddelen krachtens de van toepassing zijnde communautaire wetgeving, rekening met de criteria in punt 1 van bijlage D van het verdrag en nemen passende maatregelen om controle uit te oefenen op bestaande chemische stoffen en bestrijdingsmiddelen en om de productie, het op de markt brengen en het gebruik van nieuwe chemische stoffen en bestrijdingsmiddelen die kenmerken vertonen van persistente organische verontreinigende stoffen, te voorkomen.

(4) While legislation at Community level relating to persistent organic pollutants has been put in place, its main deficiencies are that there is an absence of, or incomplete legislation on, prohibition of the production and use of any of the currently listed chemicals, that there is no framework to subject additional persistent organic pollutant substances to prohibitions, restrictions or elimination, nor any framework to prevent the production and use of new substances that exhibit persistent organic pollutant characteristics.
(4) Hoewel er communautaire wetgeving inzake persistente organische verontreinigende stoffen is ingevoerd, zijn de belangrijkste tekortkomingen ervan dat er geen of onvolledige wettelijke voorschriften bestaan om de productie en het gebruik van enige momenteel op de lijst opgenomen chemische stof te verbieden, te beperken of te elimineren, noch enig kader om de productie en het gebruik van nieuwe stoffen die kenmerken van persistente organische verontreinigende stoffen vertonen, te verbieden.
