(3a) In the light of this Directive the Commission should submit every year to the European Parliament and to the Council a statistical report with reliable and accurate data on the current situation, trends and developments in falsified medicinal products, including details of where, how and by whom the falsified products were detected, the country in which they originated, and the ‘falsified’ element itself (identity, source and/or ingredient/components) in the Member States and update the measures on the application of the safety features accordingly.

Measures to combat terrorist offences and other serious offences can be a legitimate ground to allow processing of personal data — even if incompatible with the purposes for which the data were originally collected — provided that the necessity of the intrusion is supported by clear and undeniable elements, and the proportionality of the processing is demonstrated.
Maatregelen om terroristische misdrijven en andere ernstige strafbare feiten kunnen een rechtmatige reden zijn om de verwerking van persoonsgegevens toe te staan — ook al is dat in strijd met de doeleinden waarvoor de gegevens oorspronkelijk zijn verzameld — op voorwaarde dat de noodzaak voor deze inbreuk op de privacy wordt ondersteund door duidelijke en onweerlegbare elementen en dat de evenredigheid van de verwerking wordt aangetoond.

In particular, the assessment shall be based on an examination of the following elements: the type of data, the purposes and duration of processing for which the data are transferred, the country of origin and the country of final destination, the general and sectoral rules of law applicable in the third country or body in question, the professional and security rules which are applicable there, as well as the existence of sufficient safeguards put in place by the recipient of the transfer.
Deze toetsing vindt plaats op basis van onderzoek van volgende elementen: het soort gegevens, het doel en de duur van de verwerking waarvoor de gegevens worden doorgegeven, het land van oorsprong en het land van uiteindelijke bestemming, de algemene en sectorale rechtsregels die van toepassing zijn in het derde land of internationale orgaan, de beroepscode en veiligheidsregels die er gelden, alsmede het bestaan van voldoende waarborgen bij de ontvanger van de door te geven gegevens.

2. Member States shall ensure that the adequacy of the level of protection afforded by a third country or international body shall be assessed in the light of all the circumstances for each transfer or category of transfers. In particular, the assessment shall result from an examination of the following elements: the type of data, the purposes and duration of processing for which the data are transferred, the country of origin and the country of final destination, the general and sectoral rules of law applicable in the third country or body in question, the professional and security rules which are applicable there, as well as the existence of sufficient safeguards put in place by the recipient of the transfer.
