TRADUCTIONS EN CONTEXTE

1. Notwithstanding the provisions of Chapter I of this Title, a Community company or a Tajik company established in the territory of the Republic of Tajikistan or the Community respectively shall be entitled to employ, or have employed by one of its subsidiaries or branches, in accordance with the legislation in force in the host country of establishment, in the territory of the Republic of Tajikistan and the Community respectively, employees who are nationals of Community Member States and the Republic of Tajikistan respectively, provided that such employees are key personnel as defined in paragraph 2, and that they are employed exclusively by companies, or branches. The residence and work permits of such employees shall only cover the period of such employment.
1. In afwijking van het bepaalde in hoofdstuk I van deze titel heeft een vennootschap uit de Gemeenschap of een Tadzjiekse vennootschap die op het grondgebied van respectievelijk de Republiek Tadzjikistan of de Gemeenschap gevestigd is het recht, met inachtneming van de wetgeving van het gastland van vestiging, op het grondgebied van respectievelijk de Republiek Tadzjikistan en de Gemeenschap werknemers die onderdanen zijn van respectievelijk de lidstaten van de Gemeenschap en van de Republiek Tadzjikistan in dienst te nemen of deze door een van haar dochterondernemingen of filialen in dienst te laten nemen, mits dergelijke werknemers een sleutelpositie in de zin van lid 2 van dit artikel bekleden en zij uitsluitend in dienst zijn van deze vennootschappen of filialen. E. whereas the social partners in general, and in those branches of industry with workers with a lower than average life expectancy in particular, have a serious responsibility with regard to the in and outflow of workers and can be the primary supporting parties in ensuring an effective age-conscious personnel policy,

(f) by effecting the progressive abolition of restrictions on freedom of establishment in every branch of activity under consideration, both as regards the conditions for setting up agencies, branches or subsidiaries in the territory of a Member State and as regards the subsidiaries in the territory of a Member State and as regards the conditions governing the entry of personnel belonging to the main establishment into managerial or supervisory posts in such agencies, branches or subsidiaries.

(f) by effecting the progressive abolition of restrictions on freedom of establishment in every branch of activity under consideration, both as regards the conditions for setting up agencies, branches or subsidiaries in the territory of a Member State and as regards the subsidiaries in the territory of a Member State and as regards the conditions governing the entry of personnel belonging to the main establishment into managerial or supervisory posts in such agencies, branches or subsidiaries;

‘1a. Where, in accordance with Article 14(2)(a) of the Regulation, a person who is a member of the travelling or flying personnel of an international transport undertaking is subject to the legislation of the Member State in whose territory the registered office or place of business of the undertaking, or the branch or permanent establishment employing him, is located, or where he resides and is predominantly employed, the institution designated by the competent authority of that Member State shall issue to the person concerned a certificate stating that he is subject to its legislation’.
„1 bis. Indien degene die overeenkomstig artikel 14, lid 2, punt a), van de verordening behoort tot het rijdend, varend of vliegend personeel van een onderneming welke internationaal vervoer verricht, onderworpen is aan de wetgeving van de lidstaat op het grondgebied waarvan zich, naar gelang van het geval, ofwel de zetel van de onderneming, ofwel het filiaal of de vaste vertegenwoordiging waar hij werkzaam is, bevindt, dan wel zijn woonplaats of de plaats waar hij in hoofdzaak werkzaam is, verstrekt het orgaan dat is aangewezen door de bevoegde autoriteit hem een bewijs waarin wordt verklaard dat hij aan de wetgeving van deze lidstaat is onderworpen”.

The following paragraph shall be added:" 1a. Where, in accordance with Article 14(2)(a) of the Regulation, a person who is on the travelling or flying personnel of an international transport undertaking is subject to the legislation of the Member State in whose territory the registered office of the undertaking, or the branch or permanent establishment employing him is located, or where he resides and is predominantly employed, the institution designated by the competent authority of that Member State shall issue to the person concerned a certificate stating that he is subject to its legislation".

The organisation should have a tight control on all its personnel and offices, including all branches and offices within and outside the Community, and it should establish its own safety and pollution prevention performance targets and indicators.
De organisatie moet al haar personeel en kantoren, ook alle bijkantoren en dependances binnen en buiten de Gemeenschap, goed onder controle hebben, en moet haar eigen prestatiedoelen en -indicatoren op veiligheids- en verontreinigingspreventiegebied vaststellen.

2. A person normally employed in the territory of two or more Member States shall be subject to the legislation determined as follows: (a) a person who is a member of the travelling or flying personnel of an undertaking which, for hire or reward or on its own account, operates international transport services for passengers or goods by rail, road, air or inland waterway and has its registered office or place of business in the territory of a Member State, shall be subject to the legislation of the latter State, with the following restrictions: (i) where the said undertaking has a branch or permanent representation in the territory of a Member State other than that in which it has its registered office or place of business, a person employed by such branch or permanent representation shall be subject to the legislation of the Member State in whose territory such branch or permanent representation is situated;
2.
