3. In exceptional circumstances where duly justified by an appropriate analysis and if it is necessary to remove an identified unacceptable threat to maritime safety, to health or to the environment due to a serious weakness or anomaly in an existing standard for a specific item of marine equipment indicated by the Commission pursuant to Article 35(2) or (3) and taking into account any ongoing work at IMO level, the Commission shall be empowered to adopt, by means of delegated acts in accordance with Article 37, harmonised technical specifications and testing standards for that specific item of marine equipment, to the extent necessary to remedy the serious weakness or anomaly only .

In order to meet the objectives of Article 9(1) of Decision No 243/2012/EU and taking into account the analysis of technology trends, future needs and demand for spectrum, together with an analysis of data collected under Article 2 of this Decision, the Commission may include in these reports possible specific options for accommodating the identified needs and maximising the efficiency of the use of spectrum taking into account drawbacks (including costs for users, manufacturers and the financial budget of the Union on the one hand and of the Member States concerned on the other) and benefits, including an analysis of the overall effects of those options.

It is perfectly obvious that the withdrawal from election made by Mr Occhetto is the result of an expression of will that has been affected and vitiated by an agreement made prior to the proclamation of those elected in the 2004 European elections, that this agreement was entered into with the other member of the Società civile Di Pietro-Occhetto list, and that this withdrawal must be considered incompatible with the letter and spirit of the Act of 1976, and specifically with Article 6.

Where in the case of a linked credit agreement, as defined in Article 3(n), national legislation at the time of the entry into force of this Directive already provides that funds cannot be made available to the consumer before the expiry of a specific period, Member States may exceptionally provide that the period referred to in paragraph 1 of this Article may be reduced to this specific period at the explicit request of the consumer.

Indien voor een gelieerde kredietovereenkomst, zoals gedefinieerd in artikel 3, onder n), nationale wetgeving op de datum van inwerkingtreding van deze richtlijn reeds voorschrijft dat de gelden niet ter beschikking gesteld kunnen worden van de consument voor het verstrijken van een specifieke periode, kunnen lidstaten uitzonderlijk bepalen dat de in het eerste lid van dit artikel bedoelde periode op uitdrukkelijk verzoek van de consument kan verkort worden tot deze specifieke periode.

When a call for competition is made by means of a notice on the existence of a qualification system provided for in Section 1, the specific contracts which are the subject of the call for competition shall be awarded on the basis of the award criteria laid down in Section 2, taking into account Article 37 concerning variants, after verification, on the basis of the rules and criteria established in accordance with Article 55 , of the suitability of qualified economic operators in accordance with the provisions set out in Article 54 on qualification systems, taking into account Article 53 concerning mutual recognition.

Wanneer de oproep tot mededinging geschiedt door een mededeling inzake het bestaan van een in afdeling 1 bedoelde erkenningsregeling, worden de specifieke opdrachten waarop de oproep tot mededinging betrekking heeft gegund op grond van de in afdeling 2 vastgestelde gunningscriteria, met inachtneming van artikel 37 betreffende de varianten, na controle van de geschiktheid van de overeenkomstig artikel 55 betreffende de erkenningsregelingen erkende economische subjecten op grond van de overeenkomstig artikel 54 opgestelde regels en criteria en rekening gehouden met artikel 53 betreffende de onderlinge erkenning.
