RECALLS that a measure applied to aviation and maritime transport should have the primary goal to allow for the sector to contribute through mitigation to the 2 degree objective established by the UNFCCC; REITERATES that the carbon pricing of global aviation and maritime transportation would generate the necessary price signal to efficiently achieve more emission reductions from these sectors and could generate large financial flows, as highlighted in the AGF and the G20 reports; In this context, TAKES NOTE of the Commission's work on carbon pricing of international aviation and maritime transport and the options under consideration in the context of ICAO and IMO for global measures to address emissions in the aviation and maritime sectors; CONCLUDES that a majority of those have the potential to generate a carbon price which could potentially also generate significant revenues; NOTES that finance available, including from auctions of aviation allowances in the EU ETS, could help to support climate action in developing countries while STRESSING that it will be up to each Member State to determine the use of public revenues in accordance with national budgetary rules and in consistency with a sound and sustainable public finances policy framework of the EU, without prejudging the ongoing negotiations at the IMO; WELCOMES an acceleration of work by ICAO to further develop options for global market-based measures to address aviation emissions; ENCOURAGES the EU and its Member States to further engage effectively in negotiations in ICAO and IMO to support carbon pricing schemes which primarily incentivise mitigation and also have the potential to generate revenue; and URGES all Parties to IMO and ICAO to further increase their efforts to make progress on market based mechanisms to address emissions from global aviation and maritime transportation.

In recent years consumers have benefitted from EU action to create a strong safety net of price caps and guarantees against “bill shocks”, and more competition which drives the market to further cut prices.

Believes that Europe faces both challenges and great opportunities with regard to RM; underlines that the EU now, as demand for RM surges globally, has the chance of reaping benefits by strengthening RM supply and efficiency while satisfying the needs of EU industries and the RM sector; emphasises that the availability of fair access to, and stable and predictable prices of, RM are of vital importance for the development potential, competitiveness, innovation and preservation of European industry; while restrictions in access and supply, particularly to CRM such as REE, as well as high price volatility, can hinder the competitiveness, eco-efficiency and innovation prospects of EU industry, especially SMEs; welcomes the fact that the Commission spearheaded the issue of RM policy with its Raw Materials Initiative (RMI) in 2008, and calls strongly on the Commission and the Member States to move towards its swift implementation; believes that resource policy and resource diplomacy are of high importance for the EU, not only with regard to industrial policy and international trade but also as a transversal issue concerning different fields of domestic policy, as well as foreign and security policy; asks the Commission to pay as much attention to this issue as to the energy issue; sees this also as a task for the European External Action Service (EEAS);

Calls for global-level solutions to be formulated to tackle speculation in agricultural commodities and extreme price volatility, as they potentially put food security at risk; recognises, however, the importance of a properly functioning futures market in agricultural commodities; takes the view that coordinated international action is the only effective means of curbing excessive speculation; supports, in this connection, the proposal by the French Presidency of the G20 that the group should agree measures to combat the increasing volatility in the prices of agricultural raw materials; advocates a worldwide notification and coordinated action system for agricultural stocks intended to provide food security; observes, therefore, that consideration should be given to maintaining stocks of vital agricultural commodities; emphasises that if these objectives are to be achieved, storage capacities must be increased and market monitoring and surveillance instruments developed; stresses in particular the alarming effects that global price volatility has on developing countries;

If climate action were taken globally, oil prices would remain stable compared to today. But if international action were only fragmented, and emission reductions did not go beyond those pledged to date, this price reduction would not materialise and oil prices would be only 15% lower than if no additional action were taken.
Als wereldwijd klimaatactie wordt ondernomen, blijven de olieprijzen stabiel ten opzichte van nu, maar als geen samenhangende internationale actie wordt ondernomen en de emissies niet verder worden gereduceerd dan tot op heden is toegezegd, dan komt van deze prijsverlaging niets terecht en komen de olieprijzen slechts 15% lager uit dan zonder enige extra maatregelen.

Assessing whether the Regulation conforms to the principle of subsidiarity (that the Community can only act if the same objective cannot be sufficiently achieved by the Member States), the Advocate General first notes that, as regards the prices charged by one operator to another for the use of their network (wholesale rates), it is clear that action at Community-level was required: national regulators having neither the power to regulate prices charged by foreign networks to networks from their Member State, nor the incentive to regulate wholesale prices charged within their territory to foreign networks.

It clarifies also that certain anti-competitive practices which appear in the "black" list (such as obstacles to parallel imports, interventions in the freedom of dealers to determine prices and discounts at the time of resale, restrictions on the freedom of offerors of spare parts and refusal to supply technical information to independent repairers) lead to automatic loss of the exemption when committed systematically or repeatedly. Due to its specificity, the new Regulation excludes the applicability of the block exemption Regulation concerning franchise agreements to the distribution of motor vehicles. Undertakings in the automobile sector who are interested in concluding franchise agreement can, however, ask for an individual exemption. Price differentials: the Commission stays vigilant The adoption of the new Regulation does not change at all the substance of the two Commission Notices which the Commission had adopted with regard to the Regulation of 1985: - The first Notice of 1985 explains, notably, the thresholds for price differentials above which the Commission could withdraw the benefit of the exemption in order to avoid that motor vehicle distribution and servicing agreements lead to closing of the markets. - The second Notice of 1991 explains the scope of action of intermediaries acting on behalf of a final user. It is also meant to clarify the conditions in which a final user may charge an intermediary with the purchase of a car within the Common Market. End of a long discussion The adoption of this Regulation comes at the end of a long discussion with interested parties, the Member States and the other institutions. A first preliminary draft had been approved by the Commission on 5 October 1994 (see Press Release IP/94/54) and was then submitted to the Member States for a first exchange of views.
Voorts wordt duidelijk vastgesteld dat bepaalde concurrentiebeperkende praktijken die op de "zwarte" lijst voorkomen (zoals de verhindering van parallel import, de inbreuken op de vrijheid van de concessiehouders de prijzen en kortingen bij wederverkoop te bepalen, de beperkingen van de vrijheid van degenen die onderdelen aanbieden en weigering technische informatie aan onafhankelijke autoreprateurs te verschaffen vanzelf ertoe leiden dat de buitentoepassingverklaring niet geldt, wanneer deze stelselmatig of herhaaldelijk worden toegepast.
