The amendment seeks to clarify the general principle that the fact that the payment service provider is instructed to handle transactions which may, or may not, be of a contractual nature can neither be the decisive factor in determining, nor influence, the distribution of obligations between payment service users. That is primarily a function of the (contractual) freedom of the parties concerned.

(30a) On the other hand, it should be a central principle that the fact that a payment service provider is instructed to handle payments which may not necessarily constitute legal transactions is not generally the decisive factor in determining, and cannot influence, the assignment of obligations existing between payment service users. Food business operators shall decide the appropriate sampling frequencies, except where Annex I provides for specific sampling frequencies, in which case the sampling frequency shall be at least that provided for in Annex I. The principle of freedom to provide services therefore precludes legislation such as the Netherlands legislation, which requires the insured to obtain prior authorisation, even under a benefits-in-kind scheme, in the case of non-hospital care provided in another Member State by a non-contracted provider.
Het beginsel van het vrij verrichten van diensten staat dus in de weg aan een wettelijke regeling als de Nederlandse, waarin van de verzekerde voorafgaande toestemming wordt geëist, zelfs in een naturastelsel, voor extramurale zorg die in een andere lidstaat is verleend door een zorgverlener waarmee geen overeenkomst is gesloten.

Although the Court confirmed that under the rules of Regulation 1408/71 reimbursement could only be made according to the tariffs of the Member State where the treatment was provided, it held that, under the principle of freedom to provide services, the insured person was entitled to additional reimbursement from the Member State of insurance if the latter's legislation would have provided for a higher level of reimbursement had the hospital treatment been received there.
