The 1998 Telecommunications Law (64) states that telecommunications services, including operation of networks supporting radio and television, are services of general economic interest but they do not have the status of public services, which are reserved only for a limited number of telecommunications services (65).
In de telecommunicatiewet van 1998 (64) is bepaald dat telecommunicatiediensten, met inbegrip van de exploitatie van netwerken voor radio en televisie, diensten van algemeen economisch belang zijn, maar dat zij niet de status van openbare diensten hebben, die is voorbehouden aan een beperkt aantal telecommunicatiediensten (65).

(c) "public telecommunications services" means telecommunications services the provision of which the Member States have specifically assigned, in particular, to one or more telecommunications entities;

Article 8 (1) of directive 90/531 (the original "utilities directive") said that the public procurement procedures were not to apply to contracts which contracting entities working in the operation of public telecommunications networks or the provision of public telecommunication services award for purchases intended exclusively to enable them to provide their services where other entities are free to offer the same services in the same geographical area and under substantially the same conditions.

These services were the telex service, mobile communications and radio and television broadcasting to the public.

'- "telecommunications services" means services whose provision consists wholly or partly in the transmission and routing of signales on a public telecommunications network by means of telecommunications processes, with the exception of radio- and television-broadcasting to the public, and satellite services'.

(3) Whereas, in accordance with Commission Directive 90/388/EEC of 28 June 1990 on competition in the markets for telecommunications services (5), Member States which maintain special or exclusive rights for the provision and operation of public telecommunications networks shall take the necessary measures to make the conditions governing access to and use of the network objective and non-discriminatory and publish them; whereas it is necessary to harmonize which specifications should be published and under which form, in order to facilitate the provision of competitive services using leased lines, within Member States and between Member States, and in particular the provision of services by companies, firms or natural persons established in a Member State other than that of the company, firm or natural person for whom the services are intended;
(3) Overwegende dat overeenkomstig Richtlijn 90/388/EEG van de Commissie van 28 juni 1990 betreffende de mededinging op de markten voor telecommunicatiediensten (5) de Lid-Staten die bijzondere of uitsluitende rechten voor de levering en exploitatie van openbare telecommunicatienetwerken handhaven, de nodige maatregelen dienen te treffen ten einde ervoor te zorgen dat de voorwaarden die de toegang tot en het gebruik van het netwerk regelen, objectief en niet-discriminerend zijn, en deze voorwaarden bekend dienen te maken; dat overeenstemming dient te worden bereikt over welke specificaties dienen te worden bekendgemaakt en in welke vorm, ter bevordering van de levering van concurrerende diensten waarbij gebruik wordt gemaakt van huurlijnen, in de Lid-Staten en tussen de Lid-Staten onderling, en in het bijzonder de levering van diensten door vennootschappen, ondernemingen of natuurlijke personen die zijn gevestigd in een andere Lid-Staat dan de vennootschap, de onderneming of de natuurlijke persoon voor wie de diensten bestemd zijn;
