(4) Since the objectives of the action to be taken, namely to reduce the contribution of phosphates from detergents to eutrophication risks and to reduce the costs of phosphates removal in waste water treatment plants, cannot be sufficiently achieved by Member States as national measures with different technical specifications cannot influence the quality of water crossing national borders, and can therefore be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

Without reducing the level so much as to make it difficult for manufacturers to gain any technological function from these phosphates, this amendment reduces the maximum level for E338 to E452 phosphates in flavourings to ensure that even if the flavouring comprised 1% of the foodstuff (the usual level is about 0.1%), the amount of phosphates in the foodstuff would be safely below the 500mg/kg limit for phosphates in foodstuffs.
Via dit amendement wordt het niveau weliswaar niet zodanig verlaagd dat het voor producenten moeilijk wordt enige technologische functie aan deze fosfaten te ontlenen, maar de maximumconcentratie voor de fosfaten E 338 tot en met E 452 in smaakstoffen wordt verlaagd om te waarborgen dat de hoeveelheid fosfaten in levenmiddelen, zelfs indien de smaakstof 1% van het levensmiddel zou vormen (het gebruikelijke niveau is ca. 0,1%), veilig onder de voor fosfaten in levensmiddelen geldende grens van 500 mg/kg zou liggen.
