7. Where it is necessary to request the extradition of a person, the handling European Delegated Prosecutor may request the competent authority of his/her Member State to issue an extradition request in accordance with applicable treaties and/or national law.

In the event of a conflict between an arrest warrant and a request for extradition presented by a third State, the decision as to whether the arrest warrant or the extradition request takes precedence shall be taken by the competent authority of the executing State with due consideration of all the circumstances, in particular those referred to in paragraph 1 and those mentioned in the applicable convention.

[77] 7 Grounds for refusal: (a) where enforcement would run counter to the fundamental principles of the legal system of the requested State; (b) where the requested State considers the offence for which the sentence was passed to be of a political nature or a purely military one; (c) where the requested State considers that there are substantial grounds for believing that the sentence was brought about or aggravated by considerations of race, religion, nationality or political opinion; (d) where enforcement would be contrary to the international undertakings of the requested State; (e) where the act is already the subject of proceedings in the requested State or where the requested State decides to institute proceedings in respect of the act; (f) where the competent authorities in the requested State have decided not to take proceedings or to drop proceedings already begun, in respect of the same act; (g) where the act was committed outside the territory of the requesting State; (h) where the requested State is unable to enforce the sentence; (i) where the request is grounded on Article 5.e ("if it considers that it cannot itself enforce the sanction, even by having recourse to extradition, and that the other State can") and none of the other conditions mentioned in that article is fulfilled; (j) where the requested State considers that the requesting State is itself able to enforce the sentence; (k) where the age of the sentenced person at the time of the offence was such that he could not have been prosecuted in the requested State; (l) where under the law of the requested State the sentence imposed can no longer be enforced because of the lapse of time; (m) where and to the extent that the sentence imposes a disqualification.
[77] Weigeringsgronden: a) de tenuitvoerlegging zou in strijd zijn met de grondbeginselen van de rechtsorde van de aangezochte staat, b) de aangezochte staat is van oordeel dat het strafbare feit waarvoor de veroordeling is uitgesproken van politieke aard is of als een zuiver militair delict moet worden beschouwd, c) de aangezochte staat meent ernstige redenen te hebben om aan te nemen dat de veroordeling is uitgelokt of ongunstig beïnvloed door overwegingen van ras, godsdienst, nationaliteit of politieke overtuiging, d) de tenuitvoerlegging is in strijd met de internationale verplichtingen van de aangezochte staat, e) het feit wordt in de aangezochte staat reeds vervolgd of die staat besluit tot vervolging over te gaan, f) de bevoegde autoriteiten van de aangezochte staat hebben besloten geen vervolging in te stellen of van verdere vervolging wegens hetzelfde feit af te zien, g) het feit is begaan buiten het grondgebied van de verzoekende staat, h) de aangezochte staat kan de sanctie niet ten uitvoer leggen, i) het verzoek berust op artikel 5, letter e) ("de staat van veroordeling meent dat hij zelf niet de sanctie ten uitvoer kan leggen, ook niet met behulp van uitlevering, en dat de andere staat dat wel kan"), en aan geen van de andere in dat artikel genoemde voorwaarden is voldaan, j) de aangezochte staat is van mening dat de verzoekende staat zelf de sanctie ten uitvoer kan leggen, k) de veroordeelde had wegens zijn leeftijd op het tijdstip waarop hij het feit beging in de aangezochte staat niet kunnen worden vervolgd, l) de sanctie is verjaard volgens de wet van de aangezochte staat, m) bij het vonnis is een ontzetting uitgesproken.
