TRADUCTIONS EN CONTEXTE

6. By 6 May 2019, the Commission shall review other legal acts adopted by the Union which regulate processing by the competent authorities for the purposes set out in Article 1(1) including those referred to in Article 60, in order to assess the need to align them with this Directive and to make, where appropriate, the necessary proposals to amend those acts to ensure a consistent approach to the protection of personal data within the scope of this Directive.
6. Uiterlijk op 6 mei 2019, gaat de Commissie na of andere handelingen die de Unie heeft vastgesteld in verband met verwerking door de bevoegde instanties voor de doeleinden van artikel 1, lid 1, met inbegrip van die bedoeld in artikel 60, aan deze richtlijn moeten worden aangepast en dient in voorkomend geval de nodige voorstellen in om die handelingen te wijzigen teneinde een consequente aanpak van de bescherming van persoonsgegevens binnen het toepassingsgebied van deze richtlijn te waarborgen.

European standardisation is governed by a specific legal framework consisting of three different legal acts, namely Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on Information Society services , Decision No 1673/2006/EC of the European Parliament and of the Council of 24 October 2006 on the financing of European standardisation and Council Decision 87/95/EEC of 22 December 1986 on standardisation in the field of information technology and telecommunications .

In parallel with the proposal for a Regulation of the European Parliament and of the Council adapting to Article 290 TFEU a number of legal acts providing for the use of the regulatory procedure with scrutiny (RPS) (COM(2013)451), the present proposal concerns the alignment of five legislative acts in the area of Justice which still refer to the RPS.
Parallel met het voorstel voor een verordening van het Europees Parlement en de Raad tot aanpassing van een aantal basisbesluiten waarin wordt verwezen naar de regelgevingsprocedure met toetsing, aan artikel 290 van het VWEU (COM(2013)451), heeft dit voorstel betrekking op de aanpassing van vijf wetgevingsbesluiten op het gebied van justitie waarin nog wordt verwezen naar de regelgevingsprocedure met toetsing.

In those circumstances, which were disputed by the applicant at first instance as being contradictory reasons, the Civil Service Tribunal considered, as a preliminary point, taking as a basis Commission v Birkhoff, cited above, paragraphs 58 and 59, that, in view of the evolving nature of the pre-litigation procedure, it is the statement of reasons contained in the decision rejecting the complaint which must be taken into account in the review of legality of the original act adversely affecting an official, since that statement of reasons is deemed to supplement that act.

23. The Council asked the relevant Council bodies to complete work on the draft Joint Action, so that the legal act establishing the Agency is adopted in advance of the June European Council.

The Court of First Instance dismissed the application for damages and referred to the case-law of the Court of Justice, according to which the WTO Agreement and its annexes are part of Community law, but in view of their nature and structure they do not in principle form part of the rules by which the Court of Justice reviews the legality of acts adopted by the Community institutions; the WTO rules did not create any rights for individuals on which they could rely before the Court of First Instance.

With regard to another legal act, namely the draft rules of procedure of the Joint Supervisory Body of Europol, the Council discussed the main outstanding point related to the legal character (either administrative or judicial) of the Body.

REITERATES the importance which it attaches, in particular as regards SMEs, to the Commission's Rolling Programme for simplification of Community legislation, inter alia as a key component of the efforts to enhance competitiveness by reducing where necessary the regulatory burden on economic operators; WELCOMES the progress achieved since its session in May 2004 in identifying, on the basis of contributions from the Member States, individual legal acts which seem to offer a particular potential for simplification from the point of view of competitiveness; AGREES to submit the attached list of Council priorities for simplification, with possible solutions, to the Commission with the invitation to include these in future updates of its rolling programme of planned legislative proposals or to take any other appropriate action; NOTES in this regard that, in addition, there appears to be a clear need for codification of legal acts, in particular in the transport sector, which the Commission is invited to consider for the next phase of its codification programme; INVITES the Commission to take account of the Council's priorities for simplification and to report on the result to the Council session in March 2005; STATES its intention to pursue work on identifying, on a regular basis and on the basis of a systematic approach, priorities for simplification as a continuous process in the broader framework of Better regulation and enhancing the competitiveness of the European economy.
