find that by granting the value-added-tax exemption for the hiring of quays and moorings to the members of water sports associations not employing one or more persons for the provision of their services, in respect of sailing or leisure activities which cannot be equated with the practice of sport or physical education, the Kingdom of the Netherlands has failed to fulfil its obligations under Articles 2(1), 24(1) and 133 of Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax (‘the VAT Directive’) (1), in conjunction with Article 132(1)(m) thereof;
vast te stellen dat door vrijstelling van de btw te verlenen voor de verhuur van lig- en bergplaatsen voor vaartuigen aan leden van watersportverenigingen die voor hun dienstverlening geen gebruik maken van één of meer personen die in dienstbetrekking bij hen werkzaam zijn, voor vaar- of ontspanningsactiviteiten die niet kunnen worden gelijkgesteld met de beoefening van sport of lichamelijke opvoeding, het Koninkrijk der Nederlanden de krachtens de artikelen 2, lid 1, 24, lid 1, en 133, van richtlijn 2006/112/EG (1) van de Raad van 28 november 2006 betreffende het gemeenschappelijke stelsel van belasting over de toegevoegde waarde (de „btw-richtlijn”) in verbinding met artikel 132, lid 1, sub m, ervan op hem rustende verplichtingen niet is nagekomen;

Calls on the Member States and the competent authorities to ensure that greater stress is placed on health development in school and preschool teaching programmes by encouraging specific forms of physical activity suitable for the preschool age group and raising awareness within clubs and associations in order to ensure, for example, that children can start physical activity at the earliest possible age, for the benefit of their development and health, and hence to guarantee physical education status in accordance with the profile of the institution and the corresponding level of study;

Wij zijn het dus eensmet het verzoek aan de lidstaten en de bevoegde instanties om de bevordering van eengezonde levensstijl een prominente plaats te geven in de onderwijsprogramma’s van de scholen en kleuterscholen door specifieke vormen van lichaamsbeweging die geschikt zijn voor deze leeftijden, aan te moedigenen clubs en verenigingen bewust te maken van de noodzaak dat kinderen op een zo jong mogelijke leeftijd kunnen beginnen met lichamelijke oefening. Doel hiervan is hun ontwikkeling en gezondheid te bevorderen, en lichamelijke opvoeding voortaan in het leerplan een status te geven die past bij het profiel van de onderwijsinstelling en het studieniveau.

A number of avenues should of course be explored: campaigns using various media to raise public awareness of physical activity, theme-based partnerships with the 25 Ministries of Education and the EUPEA (European Physical Education Teacher Association) and in particular the incorporation of sport into regional policy.
